Legal description of tne stream segment through which an instream flow is claimed. lOW Tne natural stream channel from the outlet of Roosevelt Lakes at latitude 3903:3'50"N and longitude 105035'05- as the upstream terminus and extending to the conflu- ence of Bear Creek at latitude 39036'36"N and longitude 105032'07"W as the dOWIlstream terminus, being a dis- tance of approximately 4.4 miles. This segment can be located on the Harris Park U.S.G.S. quadrangle. For the stream segmente in an unsurveyed area, the Division Engineer has oetermined for administrative purposes that the approximate legal description of the instream flow termini as protracted from U.S.G.S. and/or U.S.F.S mapping is as follows: upstream termi- nus in the SE/4 NW/4, Sec. 5, T6S, R73W, 6tn P.M., 1,450 feet from the North line and 2,750 feet from the East line; downstream ~erminus in the SW/4 SW/4, Sec. 14, T5S, R73W, 6th P.M., 50 feet from the South line and 800 feet from the ~est line. 5. Use of the water: Instream flow to preserve the natural environment to a reasonable degree. 6. Date of initiation of appropriation: September 13, 1994. 7. The water was first applied to the above beneficial use on September 13, 1994, by action of the Colorado Water Conserva- tion Board under the provision of C.R.S. (1990) ~~ 37-92-102(3), 37-92-103 (3), (4), and (10). 8. Amount of water claimed (ABSOLUTE): Instream flow of 3.0 c.f.s. (May 1 - August 31); 0.5 c.f.s. (September 1 - April 30) . THE WATER REFEREE RULES: The application is granted and a decree (ABSOLUTE) in the amount of 3.0 c.f.s. (May 1 - August 31); 0.5 c.f.s. (September 1 - April 30) is entered to preserve the natural environment to a reasonable degree through the upstream and downstream points as described in paragraph 4 above. The appropriation date for this water right is September 13, 1994. 2
