Legal description of tne stream segment through which <br />an instream flow is claimed. <br /> <br />lOW <br /> <br />Tne natural stream channel from the outlet of Roosevelt <br />Lakes at latitude 3903:3'50"N and longitude 105035'05- <br />as the upstream terminus and extending to the conflu- <br />ence of Bear Creek at latitude 39036'36"N and longitude <br />105032'07"W as the dOWIlstream terminus, being a dis- <br />tance of approximately 4.4 miles. This segment can be <br />located on the Harris Park U.S.G.S. quadrangle. <br /> <br />For the stream segmente in an unsurveyed area, the <br />Division Engineer has oetermined for administrative <br />purposes that the approximate legal description of the <br />instream flow termini as protracted from U.S.G.S. <br />and/or U.S.F.S mapping is as follows: upstream termi- <br />nus in the SE/4 NW/4, Sec. 5, T6S, R73W, 6tn P.M., <br />1,450 feet from the North line and 2,750 feet from the <br />East line; downstream ~erminus in the SW/4 SW/4, Sec. <br />14, T5S, R73W, 6th P.M., 50 feet from the South line <br />and 800 feet from the ~est line. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />September 13, 1994. <br /> <br />7. The water was first applied to the above beneficial use <br />on September 13, 1994, by action of the Colorado Water Conserva- <br />tion Board under the provision of C.R.S. (1990) ~~ 37-92-102(3), <br />37-92-103 (3), (4), and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of <br />3.0 c.f.s. (May 1 - August 31); 0.5 c.f.s. (September 1 - April <br />30) . <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the <br />amount of 3.0 c.f.s. (May 1 - August 31); 0.5 c.f.s. (September 1 <br />- April 30) is entered to preserve the natural environment to a <br />reasonable degree through the upstream and downstream points as <br />described in paragraph 4 above. The appropriation date for this <br />water right is September 13, 1994. <br /> <br />2 <br />
