The use of the water: <br /> <br />This appropriation is made pursuant to C.R.S. 1973, <br />37-92-102 (3) and 37-92-103(3) and (4), The purpose <br />of this appropriation by the State of Colorado is to <br />insure the preservation of a minimum strear.o level to <br />protect the natural environment to a reasonable degree. <br /> <br />8. The Applicant, by Stipulation, does not ad:nowledge at this <br />time any rights to water by the United States of America, but in the <br />future if the United States of America shall seek appro?riate judicial <br />determination of any clained .....ater rights in the v;atershed involved <br />herein, the Applicant stipulates and agrees that its right shall be <br />subject to any adjudicated senior right of the United States of America. <br /> <br />9. The priority nerein awarded said Tar-ryall Creek (above <br />Tarryall Reservoir) ~as filed in the Water Court in the year of 1977 <br />and shall be ad~inistered as having been filed in that year; and shall <br />be ju~ior to all priorities filed in previous years.
