Legal description of the stream segment through which an in stream flow is <br />claimed: <br />The natural stream channel from the headwaters of Bitter Creek at latitude <br />390 34' 45" N and longitude 1080 59' 43" W as the upstream terminus and <br />extending to the Colorado-Utah Stateline at latitude 390 30' 59" N and <br />longitude 109003' 03" W as the downstream terminus, being a distance of <br />approximately 5.8 miles. This segment can be located on the Baxter Pass <br />and Rat Hole Ridge U.S.G.8. quadrangles. <br /> <br />For administrative purposes only: <br />Upper Terminus == NW SE SEC 31 TWN 5S RNG 103W 6PM <br />1360 West of East Section Line & 2025' North of South Section Line <br />UTM 4382 784N 12672 119E <br />Lower Terminus == NW NW SEC 25 TWN 6S RNG 105W 6PM <br />0' East of West Section Line & 655' South of North Section Line <br />UTM 43 75 702N 12667 560E <br /> <br />5. Use of the water: <br />Instream flow to preserve the natural enviromnent to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br />January 22, 2003 <br /> <br />7. The water was first applied to the above beneficial use on January 22,2003, by <br />the action of the Colorado Water Conservation Board under the provisions of C.R.S. ~ S 37- <br />92-102(3) and 37-92-103(3), (4) and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instrearn flow of 1.8 cfs (June 1 - June <br />30) and 0.4 cfs (July 1 - May 31). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of 1.8 c.f.s. <br />(June 1 - June 30) and 0.4 cfs (July 1 - May 31) is hereby entered to preserve the natural <br />environment to a reasonable degree through the stream segment described in paragraph 4 <br />above. The appropriation date for this water right is January 22,2003. <br /> <br />The priority herein awarded was filed in the water court in the year of 2003 and <br />shall be junior to all priorities filed in previous years. As between all rights filed in the <br />same calendar year, priorities shall be determined by historical date of appropriation and <br />not affected by the date of entry of ruling.
