3. The source of the water is:

Beaver Creek, tributary to the San Miguel River.

4. Legal description of the stream segment through which
an instream flow is claimed.

The natural stream channel from the confluence of Goat
Creek at latitude 37058'19"N and longitude 108011'46"W
as the upstream terminus and extending to the conflu-
ence of the San Miguel River at latitude 38006'22"N and
longitude 108011'13"W as the doWnstream terminus, being
a distance of approximately 10.6 miles. This segment
can be located on the Beaver Park and Gurley Canyon
U.S.G.S. quadrangles.

For the stream segments in an unsurveyed area, the
Division Engineer has determined for administrative
purposes that the approximate legal description of the
instream flow termini as protracted from U.S.G.S.
and/or U.S.F.S mapping is as follows: upstream termi-
nus in the NE/4 NE/4 SW/4, Sec. 21, T43N, R12W,
N.M.P.M., approximately 2100 feet east of the West
Sec~ion Line and approximately 2100 feet north of the
South Section Line; downstream terminus in the SE/4
NE/4 SE/4, Sec. 33, T44N, R12W, N.M.P.M., approximately.
100 feet west of the East Section Line and approxi-
mately 1500 feet north of the South Section Line.

5. Use of the water:

Instream flow to preserve the natural environment to a
reasonable degree.

6. Date of initiation of appropriation:

November 9, 1993.

7. The water was first applied to the above beneficial use
on November 9, 1993, by action of the Colorado Water Conservation
Board under the provisions of C.R.S. (1990) ~~ 37-92-102(3},
37-92-103 (3), (4), and (10).

8. Amount of water claimed. (ABSOLUTE): Instream flow of
5.0 c.f.s (May 1 - June 30); 2.50 c.f.s. (July 1 - April 30).
