The source of the water is: <br /> <br />Beaver Creek, tributary to the San Miguel River. <br /> <br />4. Legal description of the stream segment through which <br />an instream flow is claimed. <br /> <br />The natural stream channel from the confluence of Goat <br />Creek at latitude 37058'19"N and longitude 108011'46"W <br />as the upstream terminus and extending to the conflu- <br />ence of the San Miguel River at latitude 38006'22"N and <br />longitude 108011'13"W as the doWnstream terminus, being <br />a distance of approximately 10.6 miles. This segment <br />can be located on the Beaver Park and Gurley Canyon <br />U.S.G.S. quadrangles. <br /> <br />For the stream segments in an unsurveyed area, the <br />Division Engineer has determined for administrative <br />purposes that the approximate legal description of the <br />instream flow termini as protracted from U.S.G.S. <br />and/or U.S.F.S mapping is as follows: upstream termi- <br />nus in the NE/4 NE/4 SW/4, Sec. 21, T43N, R12W, <br />N.M.P.M., approximately 2100 feet east of the West <br />Sec~ion Line and approximately 2100 feet north of the <br />South Section Line; downstream terminus in the SE/4 <br />NE/4 SE/4, Sec. 33, T44N, R12W, N.M.P.M., approximately. <br />100 feet west of the East Section Line and approxi- <br />mately 1500 feet north of the South Section Line. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />November 9, 1993. <br /> <br />7. The water was first applied to the above beneficial use <br />on November 9, 1993, by action of the Colorado Water Conservation <br />Board under the provisions of C.R.S. (1990) ~~ 37-92-102(3}, <br />37-92-103 (3), (4), and (10). <br /> <br />8. Amount of water claimed. (ABSOLUTE): Instream flow of <br />5.0 c.f.s (May 1 - June 30); 2.50 c.f.s. (July 1 - April 30). <br /> <br />2 <br />
