Legal description ofthe stream segment through which an instream flow is <br />claimed: <br /> <br />The natural stream channel at the headwater springs at latitude 390 35' <br />49"N and longitude 1060 53' 51 "Was the upstream terminus and extending <br />to the headgate of Best Ditch at latitude 39036' 23"N and longitude 1060 <br />54' 40"W as the downstream terminus, being a distance of approximately <br />1.0 miles. This segment can be located on the Suicide Mountain U.S.G.S. <br />quadrangles. <br /> <br />For administrative purposes only: <br />Upper Terminus = SW SW SEC 23 TWN 5S RNG 85W 6PM <br />770' East of West Section Line & 640' North of South Section Line <br />UTM 4384 534N 13 3 37 071E <br />Lower Terminus = NE NW SEC 22 TWN 5S RNG 85W 6PM <br />2180' East of West Section Line & 1200' South of North Section Line <br />UTM 43 85 607N 13 3 35 925E <br /> <br />5. Use ofthe water: <br />Instream flow to preserve the natural environment to a reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br />January 22, 2003 <br /> <br />7. The water was first applied to the above beneficial use on January 22, 2003, by <br />the action oIthe Colorado Water Conservation Board under the provisions of C.R.S. S S 37- <br />92-102(3) and 37-92-103(3), (4) and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of 0.35 cfs (January 1 - <br />December 31). <br /> <br />THE WATER REFEREE RULES: <br /> <br />The application is granted and a decree (ABSOLUTE) in the amount of 0.35 cfs <br />(January I - December 31) is hereby entered to preserve the natural environment to a <br />reasonable degree through the stream segment described in paragraph 4 above. The <br />appropriation date for this water right is January 22,2003. <br /> <br />The priority herein awarded was filed in the water court in the year of 2003 and <br />shall be junior to all priorities filed in previous years.
