4. Legal description of the stream segment through which
an instream flow is claimed.

.The natural stream channel from the headwaters
in the vicinity of latitude 39033'32"N and
longitude 105031'13"W as the upstream terminus
and extending to the confluence of Bear Creek at lati-
tude 39036'45"N and longitude 105027'58"W as the down-
stream terminus, being a distance of approximately 5.3
miles. This segment can be located on the Harris Park
and Meridian Hill U.S.G.S. quadrangles.

For the stream segments in an unsurveyed area, the
Division Engineer has determined for administrative
purposes that the approximate legal description of the
instream flow termini as protracted from U.S.G.S.
and/or U.S.F.S mapping is as follows: downstream
terminus in the SE/4 SE/4, Sec. 17, T5S, R72W, 6th
P.M., 1,100 feet West and 1,000 feet North of the
Southeast corner.

5. Use of the water:

Instream flow to preserve the natural environment to a
reasonable degree.

6. Date of initiation of appropriation:

November 3, 1994.

7. The water was first applied to the above beneficial use
on November 3, 1994, by action of the Colorado Water eonservation
Board under the provision of C.R.S. (1990) ~~ 37-92-102(3),
37-92-103 (3), (4), and (10).

8. Amount of water claimed (ABSOLUTE): Instream flow of
3.0 c.f.s. (April 1 -' August 31}; 1.0 c.f.s. (September 1 - March
31) .

THE WATER REFEREE RULES:

The application is granted and a decree (ABSOLUTE) in the
amount of 3.0 c.f.s. (April 1 - August 31); 1.0 c.f.s. (September
1 - March 31) is entered to preserve the natural environment to a
reasonable degree through the upstream and downstream points as
described in paragraph 4 above. The appropriation date for this
water right is November 3, 1994.
