4. That the undersigned Water Referee held an informal
hearing on this and several other related cases on July 19,
1984, at the Judicial Building in Pueblo, Colorado, and that
those present were as follows: Steven J. Shupe, Assistant
Attorney General; Dan Merriman, Colorado Division of Wildlife;
Steve Puttmann, Colorado Water Conservation Board; and Kenneth
J. Cooper, Assistant Division Engineer. Charles M. Elliott,
Attorney for Objector, participated by telephone from Denver.
5. That Mr. Merriman and Mr. Puttmann were placed under
oath and testimony was heard.
6. That Applicant agreed to submit a proposed ruling in
the matter which will have been approved by the Objector.
7. That such a proposed ruling has been received by the
Referee which is co-signed by Attorney for Objector and
attached hereto.
8. That Applicant is entitled to the award which follows.

IT IS, THEREFORE, ORDERED AS FOLLOWS: That Applicant be,

-headwaters at Banjo Lake at latitude 38010'44" North, longitude
105042'01" West, as the upstream terminus and confluence South
Brush Creek in NEl!4 of NW1!4 of Section 27, Township 46 North,
Range 12 East of the N.M.P.M. in Custer County, Colorado, as
the downstream terminus being a distance of approximately 4.6
miles. This segment can be located on the Electric Peak (15')
U.S.G.S. quadrangle.
