COURT USE ONLY ... <br />Case No.: 02CW277 <br /> <br />Div.: 4 <br /> <br />I <br /> <br />MOTION TO APPROVE STIPULATION AND ENTER FINDINGS AND RULING <br />OF THE REFEREE AND DECREE OF THE WATER COURT <br /> <br />The Applicant, the Colorado Water Conservation Board ("CWCB"), through its <br />undersigned counsel, moves this Court to approve the Stipulation entered into with the <br />objector, JC Mesa, LLC, and to enter the attached Findings and Ruling of the Water <br />Court. As grounds therefore, the CWCB states as follows: <br /> <br />1. JC Mesa, LLC, is the remaining objector to this case. All other objectors <br />have entered into stipulations with the Colorado Water Conservation Board. <br /> <br />2. The CWCB and JC Mesa, LLC, entered into a Stipulation, dated April 10, <br />2006, which resolved the disputed issues between the parties. The Stipulation is attached <br />hereto.' , <br /> <br />3. Approval of the Stipulation between the CWCB and JC Mesa, LLC, will <br />facilitate an efficient resolution of this matter. <br /> <br />4. In situations such as this, when litigants have settled their disputes by <br />stipulation, it is appropriate for such parties to file stipulations with the Court. It is further <br />appropriate for the Court to accept such stipulations or state solid reasons why the <br />stipulation should not be accepted. Colorado River Water Conservation District v. Bar <br />Forty Seven Co., 579 P.2d 636 (1978); u.s. v. Northern Colorado Conservancy District, <br />608 F.2d 422 (10th Cir. 1979). <br />
