<br />." <br /> <br />Case No. 80 CW222 <br />Page 2 <br />Colorado Water <br />Conservation Board <br /> <br />5. <br /> <br />The date of appropriation: <br />May 7, 1980 <br />The amount of water: <br />1.5 cubic feet per second <br />The use of the water: <br /> <br />6. <br /> <br />7. <br /> <br />This appropriation is made pursuant to C.R.S. 1973, 37-92- <br />102(3) and 37-92-103(3) and (4). The purpose of this <br />appropriation by the state of Colorado is to insure the <br />preservation of a minimum stream level to protect the <br />natural environment to a reasonable degree. <br /> <br />8. The Applicant, by Stipulation, does not acknowledge at this <br />time any rights to water by the United States of America, <br />but in the future if the United States of America shall seek <br />appropriate judicial determination of any claimed water <br />rights in the watershed involved herein, the Applicant <br />stipulates and agrees that its right shall be subject to any <br />adjudicated senior right of the United States of America. <br /> <br />9. The priority herein awarded said Long Gulch Creek was filed <br />in the Water Court in the year of 1980 and shall be ad- <br />ministered as having been filed in that year; and shall be <br />junior to all priorities filed in previous years. As between <br />all rights, filed in the same calendar year, priorities <br />shall be determined by historical dates of appropriation and <br />not affected by the date of entry of ruling. <br /> <br />DATED this <br /> <br />10th <br /> <br />day of <br /> <br />June <br /> <br />, 1981. <br /> <br />1r:f1?/~,. <br />RAYM S.
