Legal description of the stream segment through which an
instream flow is claimed. Seqment 1: The natural stream
channel from confluence of Monte Cristo and Bemrose Creeks
at lat. 39 deg. 23'13"N, long. 106 deg. 03'08"W as the
upstream terminus and extending to the Highway 9 Bridge
near the confluence of Fredonia Gulch at lat. 39 deg,
24'SS"N, long. 106 deg. 02'4l"W as the downstream terminus,
being a distance of approximately 2.2 miles. Seqment 2:
The natural stream channel from the Highway 9 Bridge near
the confluence of Fredonia Gulch at lat. 39 deg. 24'SS"N,
long. 106 deg. 02'4l"W as the upstream terminus and extend-
ing to the upstream end of the highwater line of Goose Pas-
ture Tarn at full decreed capacity at lat. 39 deg.
26'S6"N, log. 106 deg. 02'00"W as the downstream terminus,
being a distance of 2.7 miles. These segments can be
located on the Breckenridge and Frisco U.S.G.S.
quadrangle(s).

For administrative purposes only, the Division Engineer for
Water Division 5 has translated the seaments thus
described into approximate protracted section, township,
and range locations from U.S.G.S. mapping as follows:
Segment 1: Upstream terminus in the NE/4 NE/4 51 T8S R78W
6th P.M.; more specifically at a point whence the SE corner
of said section bears N03 30W a distance of 4,000 ft.;
downstream terminus in SW/4 NW/4 S30 T7S R77W 6th P.M.
Seqment 2: upstream terminus in SW/4 NW/4 S30 T7S R77W 6th
P.M,; downstream terminus NE/4 NE/4 S8 T7S R77W 6th P.M.,
specifically, the inlet to Goose Pasture Tar~.

c. (1) Date of initiation of appropriation: March 14, 1986.

(2) Date water applied to beneficial use: Water was first
applied to beneficial use on March 14, 1986, pursuant to S
37-92-103(4), C.R.S. (1973).

(3) How appropriation was initiated: By applicant's
approval of its staff's final recommendations at a regu-
larly scheduled meeting, subsequent to having requested and
considered recommendations from the Division of Wildlife,
and the Division of Parks and Outdoor Recreation.

Segment 1: 2 c.f.s. (May 1 through Sept. 30), 1 c.Ls.
(Oct. 1 through Apr. 30), absolute.
