<br />DISTRICT COURT, WATER DIVISION 1, STATE OF COLORADO <br /> <br />Case No. 87-CW-272 <br /> <br />CONCERNING THE APPLICATION FOR W~TER RIGHTS OF THE COLORADO WATER <br />CONSERVATION BOARD IN JEFFERSON COUNTY <br /> <br />DISTRICT COURT, WATER DIVISION 1, STATE OF COLORADO <br />Case No. 87-CW-303 <br /> <br />CONCERNING THE APPLICATION FOR W~TER RIGHTS OF THE LOOKOUT <br />MOUNTAIN WATER DISTRICT IN JEFFEnsON COUNTY <br /> <br />STIPULATION AND AGREEMENT <br /> <br />COME NOW the Colorado Water Conservation Board ("CWCB") and <br />the Lookout Mountain Water District ("District") by their respec- <br />tive attorneys and in consideration of the mutual covenants and <br />promises set forth below, the SUfficiency of which is hereby <br />acknowledged, stipulate and agree as follows: <br /> <br />l. The CWCB shall amend its application in Case No. 87-CW- <br />272, Water Division 1, to claim a minimum instream flow of 0.5 <br />c.f.s. during the period April 16 through July 31 and 0.25 c.f.s. <br />during the period August 1 through April 15 in the natural <br />channel of Beaver Brook from the confluence with North Beaver <br />Brook in the NW/4 NE/4 of Section 14, Township 4 south, Range 72 <br />West, 6th P.M. as the upstream terminus and extending to the <br />confluence with Soda Creek in the SE/4 NW/4 of Section 8, <br />Township 4 south, Range 71 West, 6th P.M. as the downstream <br />terminus. This reach of Beaver Brook is hereinafter referred to <br />as the "Upper Segment." <br /> <br />2. The CWCB shall also amend its application in Case No. <br />87-CW-272, Water Division 1, to claim a minimum instream flow of <br />1.5 c.f.s. during the period April 16 through July 3l and 1.0 <br />c.f.s. during the period August 1 through April 15 in the natural <br />channel of Beaver Brook from the confluence with Soda Creek in <br />the SE/4 NW/4 of Section 8, Township 4 South, Range 71 West, 6th <br />P.M. as the upstream terminus and extending to the confluence <br />with Clear Creek in the NE/4 NW/4 of Section 3, Township 4 South, <br />Range 71 West. 6th P.M. as the downstream terminus. This reach <br />of Beaver Brook is hereinafter described as the "Lower Segment." <br /> <br />3. The date of appropriation for the minimum instream <br />flows on both the Upper Segment and the Lower Segment is December <br />11, 1987. <br />
