The source of the water is: <br /> <br />pierce Creek, tributary to Goose Creek, a tributary to <br />the Rio Grande. <br /> <br />4. Legal description of the stream segment through which <br />an instream flow is claimed. <br /> <br />The natural stream channel from the headwaters <br />in the vicinity of latitude 37043'10"N and <br />longitude 106053'56"W as the upstream terminus and <br />extending to the confluence of Goose Creek in the NW/4 <br />NE/4, Sec. 2, T40N, RIE, N.M.P.M. as the downstream <br />terminus, being a distance of approximately 4.5 miles. <br />This segment can be located on the Spar City and Lake <br />Humphreys U.S.G.S. quadrangles and is depicted on <br />Exhibit A. <br /> <br />For the stream segments in an unsurveyed area, the <br />Division Engineer has determined for administrative <br />purposes that the approximate legal description of the <br />instream flow termini as protracted from U.S.G.S. <br />and/or U.S.F.S mapping is as follows: upstream termi- <br />nus in the SE/4 NE/4, Sec. lS, T40N, R1E, N.M.P.M. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />March 9, 1994. <br /> <br />7. The Colorado Water Conservation Board first applied the <br />water to the above beneficial use on March 9, 1994, under the <br />provisions of C.R.S. (1990) !i!i 37-92-102 (3), <br />37-92-103 (3), (4), and (10). <br /> <br />8. Amount of water claimed (ABSOLUTE): Instream flow of <br />1.25 c.f.s (April 1 - August 15); 0.50 c.f.s.
