"-''"''' E _ ~ <br /> <br />DISTRICT COURT, WATER DIVISION <br /> <br />STIPULATION <br /> <br />APPLICATION FOR WATER RIGHTS OF THE COLORADO WATER <br />CONSERVATION BOARD, <br /> <br />IN CLEAR CREEK COUNTY <br /> <br />Applicant the Color~do Water conservation Board (the <br />wBoardW) and Objector the City of Idaho Springs (WIdaho <br />springs.), by and through their respective attorneys, hereby <br />enter into the following Stipulation: <br /> <br />1. The Board is the applicant in each of the above <br />captioned cases, which seek to confirm the appropriation of <br />water for instream flows to preserve the natural environment <br />to a reasonable degree (hereinafter the WInstream Flow <br />RightsW). <br /> <br />2. All three of the applications involve chicago <br />Creek, a tributary of Clear Creek, which is tributary to the <br />South Platte River. Case No. 86CW179 includes the segment of <br />Chicago Creek from its confluence with Clear Creek upstream to <br />its confluence with West Chicago Creek. Case No. 86CWl80 <br />includes the segment of Chicago Creek from its confluence with <br />West Chicago Creek upstream to a point approximately 1,000 <br />feet below the Chicago Creek Reservoir Dam. Case No. 86CW181 <br />includes the segment of Chicago Creek from the inlet to <br />Chicago Creek Reservoir-upstream to the headwaters of Chicago <br />Creek. I <br /> <br />3. Idaho springs owns numerous direct flow and <br />water storage rights in the Chicago Creek drainage basin (the <br />wIdaho Springs Water RightsW). The Idaho springs Water Rights <br />are described with greater particularity on Exhibit A, which <br />is attached hereto and incorporated herein by this reference. <br />In addition, Idaho Springs operates an appropriative right of <br />exchange of its Miner's Ditch water right on Chicago Creek <br />between a downstream point located at the decreed diversion <br />point of its Miner's Ditch water right and an upstream point <br />located at Idaho springs' municipal diversion works (the <br />wMunicipal Exchange RightsW).
