Legal description of the stream segment through which <br />an instream flow is claimed. <br /> <br />The natural stream channel from the headwa- <br />ters in the vicinity of latitude 39033'38"N <br />and longitude 105025'55"W as the upstream <br />terminus and extending to the confluence of <br />Bear Creek at latitude 39037'44"N and longi- <br />tude 105025'17"W as the downstream terminus, <br />being a distance of approximately 5.1 miles. <br />This segment can be located on the Meridian <br />Hill and Squaw Pass U.S.G.S. quadrangles and <br />is depicted on Exhibit A. <br /> <br />For the stream segments in an unsurveyed <br />area, the Division Engineer has determined <br />for administrative purposes that the approxi- <br />mate legal description of the instream flow <br />termini as protracted from U.S.G.S. and/or <br />U.S.F.S. mapping is as follows: upstream <br />terminus in the SW/4 NE/4, See 3, T6S, R72W, <br />6th P.M., 1,650 feet West and 2,000 feet <br />South of the Northeast corner; downstream <br />terminus in the NW/4 SW/4, See 11, T5S, R72W, <br />6th P.M., 800 feet East and 2,200 feet North <br />of the Southwest corner. <br /> <br />5. Use of the water: <br /> <br />Instream flow to preserve the natural environment to a <br />reasonable degree. <br /> <br />6. Date of initiation of appropriation: <br /> <br />November 3, 1994. <br /> <br />7. The water was first applied to the above beneficial use <br />on November 3, 1994, by action of the Colorado Water Conservation <br />Board under the provision of C.R.S. 99 37-92-102(3), <br />37-92-103 (3), (4), (10). <br /> <br />8.
