6. That on October 31, 1979, the case was remanded to

the undersigned Water Referee for investiqation and ruling

thereon.

7. That the Application herein concerns a claim made

pursuant to the provisions of C.R.S. 1973, 37-92-102(3) and

C.R.S. 1973, 37-92-103(3), (4) and (10) known as Senate Bill

97, and that the purpose of the appropriation claimed herein
by the State of Colorado is to insure the preservation of a
minimUm stream level to protect ,the natural environment to a

reasonable degree.

8. That Applicant has furnished acceptable proof as to
claims made.
