Q 'Q Rock Ditch, releasing water to Boulder Creek from Swede Lake (also known as Panama Reservoir) and diverting a like amount of water into the Boulder-White Rock Ditch at its combined headgate on Boulder Creek near the Broadway Street crossing in Boulder, Colorado, has been called out or otherwise concluded for that particular season. When the said Boulder-White Rock exchange has been called out once in any given season, the State may thereafter exer- cise its right to call, on its said Berkley Ditch priority, notwithstanding the possibility that said exchange might thereafter come back into priority. 11. The Water Refere~ finds that the aforesaid changes proposed by Applicant, if operated and administered pursuant to the conditions and limitations above set forth, will not injur-' iously affect any owner of or persons entitled to use water under a vested water right or a decreed conditional water right. CONCLUSIONS OF LAW 12. The changes of water right described herein are contemplated by law, and, if operated and administered in accordance with this ~~ling, wi~l not injuriously affect any owner of or persons' entitled to use ~ater under a vested water right or a decreed conditional right. RULING AND DECREE 13. The Application for Change of Water Right in this matter is hereby approved and granted. 14. Pursuant to the following conditions and limitations, Applicant shall be entitled to use 1.0 cfs. of water originally decreed to the G. Berkley Ditch, Boulder Creek Priority No. 11, with date of appropriation of June 1, 1862, by decrees of the District Court in and for Boulder County of June 2, 1882 and November 22, 1924, in the reach of Boulder Creek from a point immediately below the discharge of Public Service Company of Colorado's hydroelectric plant in the SW 1/4 of Section 34, -4-
