Sublease. If the serviee and Parks can agree on a price per
aere-foot for the term of a new lease, the Service shall have the
right to lease up to 3,300 acre-feet per,year, subjeet to all other
terms and conditions of this Lease and Sublease. Parks agrees to
negotiate in good faith as to the priee per aere-foot for the new
lease. ..

5. Releases. All requests for releases of leased water
shall be made by the Serviee through the CWCB to Parks. Parks
shall store and subsequently release at the direetion of the CWCB,
pursuant to requests by the Service, up to 2,000 acre-feet of water
per year from Steamboat Lake, and such additional water as is
determined to be available pursuant to paragraph 3 above. The
amount of leased water released shall be measured at the point of
release from Steamboat Lake to willow Creek (the "release point") .
The rate of release shall not exceed 200 e.f.s. as measured at the
release point. The CWCB, pursuant to requests by the Serviee, may
request releases during all months of the year, subj ect to the
following eonditions:

a. During the period July 1 - August 15, no more than
25 c.f.s. shall be released and the rate of release shall
not be varied unless approved by Parks.

b. During the period August 16 - Oetober 31, releases
shall be made to the extent praetieable and the rate of
such release shall not be varied more than once per week.

e. No releases shall take plaee during emergency
eonditions that prevent the operation of the dam outlet
works.

d. To the extent practieable, Parks shall maintain the
measuring and recording deviee, whieh ineludes a
satellite monitoring deviee, that has been installed to
measure and monitor releases from Steamboat Lake. Parks
shall provide the Service and CWCB with a record of
aetual releases on a weekly basis, exeept for such times
when the measuring and reeording deviee is inoperable due
to snow or ice buildup.

6. Sublease. The Serviee hereby subleases at no eost to the
CWCB all of its right, title, and interest in the water it leases
annually from Parks for use only by the CWCB for instream flows to
preserve the natural environment to a reasonable degree in the
Yampa River. The CWCB agrees to request administration of water to
and through oecupied habitat from the confluenee of the Yampa River
and Elkhead Creek to Dinosaur National Monument.

This sublease of water from the serviee to the CWCB is an element
of the Reeovery Implementation Program Reeovery Aetion plan to
preserve the natural environment in the Yampa River for the benefit
