;/i;>'1 '~'1 I' -I DISTRICT COURT, WATER DIVISION 6, STATE OF COLORADO Case No. 95CWI50 (90CWOI) FINDINGS OF FACT, CONCLUSIONS OF LAW, JUDGMENT AND DECREE OF THE WATER COURT CONCERNING THE APPLICATION FOR WATER RIGHTS OF THE COLORADO DIVISION OF PARKS AND OUTDOOR RECREATION AND COLORADO WATER CONSERVATION BOARD, IN ROUTT AND MOFFAT COUNTIES. This Application for Change of Water Right was filed on December 14, 1995, and was referred to the Referee for Water Division No. 6 upon filing. By an Order, issued on March 31, 1996, the Referee sua sponte re-referred this application to the Water Judge. Upon review the Court hereby finds: FINDINGS OF FACT 1. The name and address of the Co-applicants: Colorado Division of Parks and Outdoor Recreation, 1313 Sherman Street, Room 613, Denver, Colorado 80203; and Colorado Water Conservation Board, 1313 Sherman Street, Suite 721, Denver, Colorado 80203. 2. Timely and adequate notice of the application was given as required by statute, and the Court has jurisdiction over the subject matter of this proceeding and over all parties affected hereby, whether they have appeared or not. 3. Timely statements of opposition were filed by the Upper Yampa Water Conservancy District ("Upper Yampa") and Tri-State Generation and Transmission Association, Inc. ("Tri-State"). Pursuant to S 37-92-302(4), 15 C.R.S. (1990), the Division Engineer has issued a Summary of Consultation and the Applicant has served it on the aforementioned objectors. 4. The Co-applicants have entered into stipulations with Upper Yampa and Tri-State. The Court has reviewed the stipulations and has entered orders approving them and incorporating their terms herein.
