<br />. <br /> <br />. <br /> <br />Sublease. If the Service and Parks can agree on a price per <br />acre-foot for the term of a new lease, the Service shall have the <br />right to lease up to 3,300 acre-feet per year, subject to all other <br />terms and conditions of this Lease and Sublease. Parks agrees to <br />negotiate in good faith as to the price per acre-foot for the new <br />lease. <br /> <br />5. Releases. All requests for releases of leased water <br />shall be made by the Service through the CWCB to Parks. Parks <br />shall store and subsequently release at the direction of the CWCB, <br />pursuant to requests by the Service, up to 2,000 acre-feet of water <br />per year from Steamboat Lake, and such additional water as is <br />determined to be available pursuant to paragraph 3 above. The <br />amount of leased water released shall be measured at the point of <br />release from Steamboat Lake to willow Creek (the "release point") . <br />The rate of release shall not exceed 200 c.f.s. as measured at the <br />release point. The CWCB, pursuant to requests by the Service, may <br />request releases during all months of the year, subj ect to the <br />following conditions: <br /> <br />a. During the period July 1 - August 15, no more than <br />25 c.f.s. shall be released and the rate of release shall <br />not be varied unless approved by Parks. <br /> <br />b. During the period August 16 - October 31, releases <br />shall be made to the extent practicable and the rate of <br />such release shall not be varied more than once per week. <br /> <br />c. No releases shall take place <br />conditions that prevent the operation <br />works. <br /> <br />during emergency <br />of the dam outlet <br /> <br />d. To the extent practicable, Parks shall maintain the <br />measuring and recording device, which includes a <br />satellite monitoring device, that has been installed to <br />measure and monitor releases from Steamboat Lake. Parks <br />shall provide the Service and CWCB with a record of <br />actual releases on a weekly basis, except for such times <br />when the measuring and recording device is inoperable due <br />to snow or ice buildup. <br /> <br />6. Sublease. The Service hereby subleases at no cost to the <br />CWCB all of its right, title, and interest in the water it leases <br />annually from Parks for use only by the CWCB for instream flows to <br />preserve the natural environment to a reasonable degree in the <br />Yampa River. The CWCB agrees to request administration of water to <br />and through occupied habitat from the confluence of the Yampa River <br />and Elkhead Creek to Dinosaur National Monument. <br /> <br />This sublease of water from the Service to the CWCB is an element <br />of the Recovery Implementation Program Recovery Action Plan to <br />preserve the natural environment in the Yampa River for the benefit <br /> <br />6 <br /> <br />,,'';'' ~~ --<'-- <br /> <br />{,- <br /> <br />'" <br />-).,: <br /> <br />
