<br />. <br /> <br />. <br /> <br />The CWCB has cooperated extensively with the united states <br />Fish and Wildlife Service and other Recovery Program participants <br />to develop and implement a recovery plan. CWCB has developed <br />considerable expertise in the appropriation and protection of in- <br />stream flows by virtue of its authority over the statewide mini- <br />mum stream flow program. <br /> <br />2 . Purpose <br /> <br />This agreement is being entered into by Parks and CWCB in <br />order to define the responsibilities of each agency in facilitat- <br />ing the beneficial use of the water by the Fish and wildlife Ser- <br />vice and to take advantage of CWCB's special expertise in the <br />management of instream flows. <br /> <br />Parks is aware of and sensitive to the need for protecting <br />Colorado's future water development opportunities. Parks ini- <br />tiated the development of this MOA in order to assure that its <br />use of the Steamboat Lake storage rights is exercised in a manner <br />that is not detrimental to Colorado's interstate compact alloca- <br />tions and future development opportunities, or inconsistent with <br />Colorado's instream flow program. <br /> <br />Delivery of the storage releases to the habitat of the en- <br />dangered fishes, under the supervision of the CWCB, should con- <br />tribute significantly toward the success of the Recovery Program <br />efforts. <br /> <br />3. Authority <br /> <br />The authority for this agreement is contained in S <br />33-10-107(1) (d), C.R.S. (1990), for Parks and in SS <br />37-60-106(1) (k), C.R.S. (1990), and 37-92-102(3), C.R.S. (1990) <br />for the CWCB. <br /> <br />4. Responsibilities <br /> <br />The responsibilities of Parks and the CWCB are set forth <br />below: <br /> <br />4.1. Parks <br /> <br />Parks agrees to notify the CWCB within 48 hours after re- <br />ceiving a request from Fish and Wildlife Service for the release <br />of water from Steamboat Lake.
