Any water available to the subject 1.5 cfs of <br />the Boulder City Pipe Line water right which is by-passed by <br />Boulder for instream flow use by the Board under this decree <br />shall be water that would otherwise have been diverted by <br />Bo~lder at the Boulder city pipeline into its municipal water <br />supply system to meet current demand. <br /> <br />2. Boulder may by-pass water available to the <br />subject 1.5 cfs of the Boulder City Pipe Line water right for <br />instream flow use by the Board in Segment B described above <br />under this decree only to the extent required to achieve flows <br />in Segment B not exceeding a total, from all sources available <br />pursuant to this decree, of the lesser of 1.5 cfs or the <br />stream flow immediately above Lakewood Inlet (described in <br />paragraph 4.1 above). <br /> <br />3. Water available to the subject 1.5 cfs of the <br />Boulder City Pipe Line water right which is by-passed pursuant <br />to A (2) above may be used by the Board for in stream flow in <br />Segment C described above under this decree only to the extent <br />required to achieve flows in segment C not exceeding 15 cfs. <br /> <br />4. Boulder shall notify the State water <br />administration officials at least 24 hours in advance of the use of <br />the subject 1.5 cfs of the Boulder City Pipeline water right for <br />instream flow under this decree. <br /> <br />B. The right to use water available under the subject <br />1.5 cfs of the Boulder city Pipe Line water right for its decreed <br />municipal and related uses under certain drought or emergency <br />conditions and when not required for instream flow use as described <br />herein is reserved to Boulder by the Instream Flow Agreements. The <br />decreed municipal and related uses of this water right are <br />therefore retained as alternate uses. <br /> <br />4.9 Water stored in -.rker Meadow Reservoir under the water <br />rights described in paragraph 2.7 above may be used by the Board <br />for instream flow in Segment C described in paragraph 4.1 above, <br />subject to the following terms and conditions: <br /> <br />A. Water stored by Boulder in Barker Meadow Reservoir <br />has historically flowed down the Boulder Power pipeline owned by <br />Public Service Company to the Boulder City Pipeline No. 3 and from <br />
