<br />-" <br /> <br />. <br /> <br />. <br /> <br />Memorandum <br />Steamboat Lake Lease <br />July 16, 1991 <br /> <br />decree does not state that the fishery use is for instream uses, Parks believes that it <br />can be released for this purpose. <br /> <br />A number of meetings have been held with the Water Acquisition Committee, <br />Colorado Attorney General's Office, Parks, the Division Engineer, the Service and the <br />CWCB regarding this potential lease arrangement. A draft lease agreement was <br />prepared by Parks, offering the Recovery Program 2,000 af of water for a five year <br />period at the rate of $10jaf (Attachment 1). Following review of the draft agreement, <br />the Board staff revised the draft lease agreement (Attachment 2) to include concerns <br />raised by the Water Acquisition Committee and others. When this revised agreement <br />was presented to the Committee in June of 1991, the Service stated that an appraisal <br />on the value of the water rights needed to be done. Additionally we believe that the <br />Parks decree should be amended to include instream flow use as a beneficial use, and <br />that the CWCB should be one of the signatories to the agreement. <br /> <br />)<, <br /> <br />During a follow-up discussion with John Hamill regarding this issue, he has <br />indicated that before the Service can expend funds for the lease or purchase of water <br />rights or leases of water, an appraisal must be conducted to obtain a fair market value <br />price. He felt this process could take in excess of two months, which would not permit <br />the release of any water from Steamboat Lake for the purpose of this lease agreement <br />during the late summer and fall of 1991. This does however allow more time to <br />develop a lease agreement that would be satisfactory to all parties. <br /> <br />As you are aware, a meeting has been scheduled for July 30, 1991 at 10:00 am, <br />Service offices, third floor conference room, Side A, 134 Union Blvd., Lak:ewood, <br />Colorado to discuss the lease of 2,000 af from Steamboat Lake for the endangered <br />fish.
