<br />60181-2-1021 <br />Page 2 of 3 <br /> <br />. <br /> <br />. <br /> <br />Terms and Conditions <br />Related to the <br />Purchase of Water from Steamboat Lake, Routt County, <br />Colorado, to Benefit the Endangered Colorado River <br />Fishes in the Yampa River <br /> <br />RELEASE OF WATER <br /> <br />a. Colorado Department of Parks and Outdoor Recreation (Parks) shall <br />release up to 2,000 acre feet (a. f.) of water over a 25 day period <br />from October 7, 1991, through October 31, 1991, into Willow Creek <br />then to the Elk River and downstream into the Yampa River to the <br />eastern boundary of Dinosaur National Monument. Any water not <br />released during this period i. not available for future use. <br />. s <br />b. The water shall be released at a rate of 40.33 cubic feet per second <br />(cfs) over the 25 day period. This release schedule can be modified <br />by the U.S. Fish and Wildlife Service (Service) up to 24 hours prior <br />to the release, subject to item c below. <br /> <br />c. The rate of release shall not exceed 200 cfs as measured at the <br />point of release (this rate would equal apprOXimately <br />396.70 a.f./day). <br /> <br />ADMINISTRATION <br /> <br />a. The amount of water released will be determined at the outlet of <br />Steamboat Reservoir. <br /> <br />b. Parks will be responsible for advising/coordinating with the State <br />Division Engineer regarding all releases to assure delivery to and <br />through occupied habitat of the endangered fish in the Yampa River <br />from Hayden, Colorado, to the eastern boundary of Dinosaur National <br />Monument. <br /> <br />DELIVERABLE <br /> <br />a. Parks shall provide the Service with a record of actual releases and <br />evidence of delivery of the water to and through occupied habitat in <br />the Yampa River from Hayden, Colorado, to the eastern boundary of <br />Dinosaur National Monument. <br /> <br />PAYMENT <br /> <br />a. An invoice shall be submitted with evidence of deliver} upon <br />completion of release(s). <br /> <br />b. Payment shall be made to Parks only for the amount of water <br />delivered to the eastern boundary of Dinosaur National Monument, up <br />to 2,000 a.f. However, normal transit loss (as computed by the <br />Division Engineer) shall not affect the amount paid. If less than <br /> <br />.t.<. ",-,1L,~;~ ,.... <br />
