There are other decreed points of diversion for <br />the Boulder City pipe Line which are not involved in this <br />application. <br /> <br />2.9 The Anderson Ditch, Farmers Ditch, Harden Ditch, McCarty <br />Ditch and smith and Goss Ditch water rights described 1n <br />paragraphs 2.1 through 2.S above are owned by the Board pursuant to <br />conveyances from Boulder under the terms of the Instream Flow <br />Agreements, subject to the retention by Boulder of the right to use <br />these water rights under certain conditions. <br /> <br />2.10 The Silver Lake Reservoir, Barker Meadow Reservoir and <br />Boulder city pipe Line water rights described in paragraphs 2.6 <br />through 2.8 above are owned by Boulder. Water released from Silver <br />Lake Reservoir or Barker Meadow Reservoir, or bypassed at the North <br />Boulder Creek point of diversion for the Boulder city Pipe Line <br />described in paragraph 2.8.C above, will be made available by <br />Boulder to the Board for instream flow use pursuant to the terms of <br />the Instream Flow Agreements. <br /> <br />III. CHANGE OF WATER RIGHTS TO MmfICIPAL USE. <br /> <br />3.1 The 2.4781 New Anderson Ditch Company shares, the <br />2 Mccarty Ditch Company shares and the 9.4 Smith and Goss Ditch <br />Company shares which have not previously been changed from their <br />originally decreed use for irrigation ("agricultural rights") are <br />proposed to be changed to new points of diversion and to municipal <br />use (including domestic, irrigation, commercial, industrial and <br />recreation use) in the Boulder water supply system. <br /> <br />3.2 The proposed new points of Iii version for the agricultural <br />rights are described as follows: <br /> <br />A. Lakewood Pioeline: The pipeline intake from <br />Lakewood Reservoir also known as Headgate No. 1 of the Boulder City <br />pipeline (Lakewood Pipeline), located at a point whence the SE <br />corner of section 1, Township 1 south, Range 73 West of the 6th <br />P.M. bears S3'lS'E a distance of 2300 plus/minus feet; <br /> <br />B. Silver Lake Pioeline: Headgate No. 3 of the Boulder <br />City pipeline, located at a point whence the NW Corner of <br />Section 34 Township 1 North, Range 73 West of the 6th P.M. bears <br />N7703S'W a distance of 1076 plus/minus feet; <br /> <br />C. Barker Pioeline: The pipeline intake from Barker <br />Reservoir, located at a point whence the NW corner of section 17, <br />Township 1 south, Range 72 West of the 6th P.M. bears N16004'W a <br />
