<br /> <br />This conveyance is made subject to the <br />express condition and limitation that <br />the subjQct water right shall be forever <br />held for the protection of the environ- <br />ment including instremn flow uses and <br />for no purpose inconsistent therewith. <br />In the event this condition shall be <br />violated, the water right shall revert <br />to gran tor. <br /> <br />10. The hour and place of closing shall be designated by <br /> <br />the Conservancy. <br /> <br />11. Time is of the essence hereof, and if any payment or <br /> <br />any other condition hereof is not made, tendered or performed <br /> <br />by either the Conservancy or State as herein provided. then this <br />contract, at the option of the party who is not in default, may <br />be terminated by such party, in which case the non-defaulting <br />party may recover such damages as may be p~oper. <br />12. lbis Contract may only be amended by written agree- <br />ment executed by all parties hereto. <br />13. This Contract shall not be deemed valid until it <br />shall have been approved by the Controller of the State of <br /> <br />Colorado or such assistant as he may designate. This provision <br />is applicable to any contract involving the payment of money by <br /> <br />the State. <br />14. Financial obligations of the State of Colorado payable <br />after the current fiscal year are contingent upon funds for that <br /> <br />purpose being appropriated, budgeted and otherwise made available~ <br /> <br />15. Provisions of 8-17-101 and 102, C.F.S. 1973 for pre- <br /> <br /> <br />ference of Colorado labor are applicable to this Agreement if <br /> <br />public works within the State are undertaken hereunder and are <br />financed in whole or in part by State funds. <br />16; The laws of the State of Colo~ado and rules and regu- <br />lations issued pursuant thereto shall be applied in the interpre- <br /> <br />tation, execution and enforcement of this Agreement.
