This conveyance is made subject to the
express condition and limitation that
the subjQct water right shall be forever
held for the protection of the environ-
ment including instremn flow uses and
for no purpose inconsistent therewith.
In the event this condition shall be
violated, the water right shall revert
to gran tor.

10. The hour and place of closing shall be designated by

the Conservancy.

11. Time is of the essence hereof, and if any payment or

any other condition hereof is not made, tendered or performed

by either the Conservancy or State as herein provided. then this
contract, at the option of the party who is not in default, may
be terminated by such party, in which case the non-defaulting
party may recover such damages as may be p~oper.
12. lbis Contract may only be amended by written agree-
ment executed by all parties hereto.
13. This Contract shall not be deemed valid until it
shall have been approved by the Controller of the State of

Colorado or such assistant as he may designate. This provision
is applicable to any contract involving the payment of money by

the State.
14. Financial obligations of the State of Colorado payable
after the current fiscal year are contingent upon funds for that

purpose being appropriated, budgeted and otherwise made available~

15. Provisions of 8-17-101 and 102, C.F.S. 1973 for pre-

ference of Colorado labor are applicable to this Agreement if

public works within the State are undertaken hereunder and are
financed in whole or in part by State funds.
16; The laws of the State of Colo~ado and rules and regu-
lations issued pursuant thereto shall be applied in the interpre-

tation, execution and enforcement of this Agreement. Any provision
