(hereinafter referred to <br />as "instream flow segment") . <br /> <br />B. Use: This water is used to preserve the natural <br />environment to a reasonable degree;pursuant to ~~ 37-92-102(3), <br />37-92-103 (3), (4) and (10) C.R.S.. (1990). <br /> <br />C. Amount: 300 c.f.s. (absolute) for instream purposes <br />to preserve the natural environment to a reasonable degree. <br /> <br />D. Determinations bv the Colorado Water Conservation <br />Board: On January 22, 1992, the Colorado Water Conservation <br />Board made the following determinations concerning the instream <br />flow segment: <br /> <br />(1. A natural environm~nt does exist on the identi- <br />fied segment of the Gunnison Riverl <br /> <br />(2. Water is available, in the stream reach for use by <br />the donated water right to be changed. <br /> <br />(3. A natural environment will be preserved to a <br />reasonable degree by the water available to the water right to be <br />changed. <br /> <br />(4. There is a natural' environment that can be <br />preserved to a reasonable degree by changing the donated water <br />right to an instream flow use. <br /> <br />(5. The natural environment identified in the river <br />segment stated above can exist without material injury to water <br />rights. <br /> <br />E. plan of Ooeration for Chanaed Water Riahts: <br /> <br />Descriotion of the Ooer~tions of the Donated Riaht. <br />The donated water right is the fir~t 300 c.f.s. of the 800 c.f.s. <br />conditional Rabbit Gulch Canal decree. The remaining 500 c.f.s. <br />of the Rabbit Gulch Canal decree will be retained by P&M but <br />subordinated to the donated water right. P&M will only divert <br />500 c.f.s. of the 800 c.f.s. condi~ional water right, with the <br />remaining 300 c.f.s. to remain in the stream reach identified in <br />paragraph 3A. Subject to the terms and conditions set forth in <br />paragraph 4 of this decree, the do~ated water right shall be used <br />for instream purposes when in prio~ity, 24 hours a day, year <br />around. . <br /> <br />4 <br />
