THE COURT, having considered the pleadings as well as the stipulations of the parties does hereby find, conclude, order and decree as follows: FINDINGS OF FACT 1. Applicant Information: Colorado Water Conservation Board 1313 Sherman Street, Suite 721 Denver, CO 80203 (303) 866-3441 The applicant will be referred to in this decree as either applicant or CWCB. 2. The Nature of the Application: On or about August 13, 1992, applicant CWCB filed this application to obtain water court approval to change a conditional water right to instream flow uses. The application was published as required by law, in the water court resume and the appropriate local newspapers. The following information concerns the right to be changed: A. Name of Structure Rabbit Gulch Canal (also known as Lamm Canal), from previ- ous decree: (1. Date Entered: August 11, 1969. Case No. C-S873" Delta County District court. (2. Point of Diversion: The headgate of the Rabbit Gulch Canal is located at the point of discharge of the outlet works of the Cedar Flats Reservoir (also known as Lamm Reser- voir), which is at a point whence the Northeast Corner of Sec. 7, T1SS, R93W, 6th P.M. bears N71 deg. 36'E 3,769 feet.
