<br />00113 OPENING OF PRqPOSALS. BIDDERs are invited to be present at the opening of the <br />Proposals. <br /> <br />00114 A WARD OF CONTRACT. The OWNER reserves the right to award the Contract at any time <br />within sixty (60) days from the date of the opening of BIDs unless otherwise specified in the <br />FIELD ORDER. The OWNER further reserves the right to reject any and all BIDs and waive <br />any and all informalities, and the right to disregard all non conforming or conditional BIDs or <br />counter proposals. <br /> <br />In evaluating BIDs, OWNER will consider the qualifications of the BIDDERs, whether or not <br />the BIDs comply with the prescribed requirements, and alternates and unit prices if requested in <br />the Proposal forms. The OWNER will also consider the qualifications and experience of <br />Subcontractors and other persons and organizations (including those who are to furnish the <br />principal items of material or equipment) proposed for those portions of the WORK as to which <br />the identity of Subcontractors and other persons and organizations must be submitted as specified <br />on the Proposal Form. The OWNER will conduct such investigations as it deems necessary to <br />establish the responsibility, qualifications and financial ability of the BIDDERs, Subcontracts <br />and other persons and organizations to do the WORK in accordance with the CONTRACT <br />DOCUMENTS to the OWNER's satisfaction within the prescribed time. The OWNER reserves <br />the right to reject the BID of any BIDDER who does not pass any such evaluation to OWNER's <br />satisfaction. <br /> <br />If a Contract is to be awarded, it will be awarded to the lowest responsible BIDDER whose <br />evaluation by OWNER indicates to the OWNER that the award will be in the best interests of the <br />PROJECT. If the Contract is to be awarded, OWNER will give the apparent successful BIDDER <br />a NOTICE OF AWARD within sixty days after the day of the BID Opening. <br /> <br />00115 PRE-BID CONFERENCE SYNOPSIS. BIDDERs are required to acknowledge the receipt of the <br />ADDENDA which includes the Pre-BID Conference Synopsis on the BID FORM in the place <br />provided and include it with the Proposal when submitting the BID. <br /> <br />00116 TAXES. Effective as of June 7,1979, all sales of construction and building materials to <br />contractors and subcontractors for use in the building, erection. alternation or repair of structures, <br />highways, roads, streets and other public works owned and used by the OWNER are exempt <br />from State and RTD sales and use taxes. However, such materials will be subject to sales and <br />use taxes imposed by other local taxing authorities. <br /> <br />00117 REJECTION OF BIDS. If any of the below listed items are encountered, then the BID shall not <br />be publicly read at the time of BID opening and shall be deemed an unacceptable BID. <br />1. The CONTRACT DOCUMENTS not bound as delivered to the BIDDER at the time of <br />purchase (excluding BID BOND). (See Section (0101). <br />2. BID not signed on page 00300-3 by an authorized person of the corporation or company <br />(see Section 00 103). <br />3. BIDDER not acknowledging receipt of all addenda on the BID FORM (see Section <br />(0104). <br />4. BID not accompanied by acceptable proposal guarantee (see Section 00108). <br />5.
