<br />. <br /> <br />CoR.S AUTHORITY .. <br />WHEREAS, Section 37-60-l06(1)(c), Colorado Revised Statutes, requires the Colorado .. <br />Water Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-28-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along <br />any storm or floodwater nmoff channel or basin only after designation and approval by the <br />Colorado Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)( c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater nmoff channels or basins <br />and to make such designations available to legislative bodies of local jurisdictions; and <br /> <br />COMPLIANCE WITH CWCB TECHNICAL STANDARDS <br />WHEREAS, the approximate floodplain information presented in said report dated March <br />1996 for the City and County of Denver is not consistent with the requirements for approximate <br />floodplain information listed under the Board's "Rules and Regulations for the Designation and <br />Approval of Floodplains and of Stonn or Floodw;lter Runoff Channels in Colorado" (2 CCR 408-1) <br />due to the fact that hydrologic analyses and 100-year peak flow values were not developed or are <br />not available for the flooding sources as listed in Table 3; and <br /> <br />WHEREAS, the CWCB's Guidelines for Determining 100-year Flood Flows for <br />Approximate Floodplains in Colorado do not prOvide a regional regression equation for estimating e <br />100-year peak flow values for streams within the City of Denver or the Urban Drainage and Flood <br />Control District; and <br /> <br />WHEREAS, the City of Denver should follow local floodplain ordinances and Federal <br />Regulations concerning floodplain development ;lI1d construction activities within the approximate <br />(Zone A) floodplain areas, as listed in Table 3, and require that detailed hydrologic analyses be <br />performed by a registered professional engineer and submitted by the developer prior to a <br />floodplain development permit being issued; and <br /> <br />WHEREAS, the detailed floodplain information presented in said report dated March 1996 <br />for the City and County of Denver is consistent with the requirements for detailed floodplain <br />information listed under the Board's "Rules and Regulations for the Designation and Approval of <br />Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1) <br /> <br />DESIGNATION AND APPROVAL ACTION <br />NOW, THEREFORE, BE IT RESOLVED by the Colorado Water Conservation Board in <br />regular meeting assembled in Alamosa, Colorado, this 22nd day of May 2000, that it does hereby <br />designate and approve as approximate 100-year floodplain infonnation the Zone A areas presented <br />in said report (with included Flood Insurance Rate Maps) dated March 1996, and as listed in Table <br />3, providing that the City of Denver require that detailed hydrologic analyses be performed by a <br /> <br />e <br /> <br />II <br />
