<br />317.2.1.2 <br /> <br />317.2.1.3 <br /> <br />317.2.1.4 <br /> <br />317.2.1.5 <br /> <br />completion within the time per'iod specified in the Contract <br />Documents or any extension thereof, or fans to comp'fete said Work <br />within such time, or is in default for any of the reasons set <br />forth in 317.2.1.5 the Owner may, upon 'ten (10) days' written <br />notice to the Contractor and his Surety, terminate the Contractor's <br />right to proceed with the 'Nork or such part of the Work as to <br />which there has been delay. In such event, the Owner may take <br />over the Work and prosecute the same to completion by contract or <br />otherwise and may take possession and use in comp'feting of the <br />Hork such material, appl iances end plant as may be en the Project <br />Site and necessary therefor. Hhether or not the Contractor's <br />right to proceed with the ,Iork is terminated, he and his Surety <br />shall be liable for any damage to the Owner resulting from his <br />refusal or failure to complete the Hork within the time period in <br />the Contract Documents. <br /> <br />In the event of such Termination for Default, the Owner may <br />exclude the Contractor from the Project Site without incurring any <br />1 iabil ity toward the Contractor for trespass or conversion, or <br />waiving any rights, clai~s or causes of action it may have against <br />the Contractor. <br /> <br />If the Contract provides for liquidated damages and if the Owner <br />terminates the Contractor's right to proceed, the resulting damage <br />will consist of such liquidated damages until such reasonable time <br />as may be required for Final Completion of the Project together <br />with any increased costs to the Owner incurred in completing the <br />Project. <br /> <br />If the Contract provides for 1 iqu'idated damages and if the Owner <br />does not terminate the Contractor's right to proceed, the resulting <br />damage will consist of such liquidated damages until the Project is <br />completed. <br /> <br />The Owner may also terminate the Contract for default if anyone <br />of the following events Should occur: <br /> <br />(1) If the Contractor files a petition under the Bankruptcy Act. <br /> <br />(2) If the Contractor makes a gf'neral assignment for the benefit <br />of creditors. <br /> <br />(3) A trustee or receiver is appointed for the Contractor or any <br />of the Contractor's property. <br /> <br />(4) The Contractor repeatedly fails to supply sufficient skilled <br />workmen or suitable materials or equipment. <br /> <br />(5) The Contractor repeotedly disregards laws, ordinances, rules <br />regulations or orders of any public body having jurisdiction <br />over the Project. <br /> <br />GC - 21 <br />
