<br />316.8 <br /> <br />316.9 <br /> <br />316.10 <br /> <br />316.11 <br /> <br />written Change Order, except in the case of an emergency, where he shall <br />proceed according to paragraph 309.7. <br /> <br />Adjustments in the Contract Price which may result from extra Work <br />ordered in a Change Order, shall al so be provided in the Cllange Order. <br />The amount of any Contract Price increase shall be as follows: <br /> <br />(1) Based in the unit price for the item offered in the Bid. <br />(2) A lump sum agreed to by the Owner and Contractor; or <br />(3) An amount determined by the Engineer based on a reasonable analysis <br />of the Contractor's increased costs with and allowance for overhead <br />and profit; or <br /> <br />In determining a proper increase in the Contract Price, the Engineer <br />shall consider the Contractor's actual increc,sed costs for labor, <br />materials, equipment, payments to Subcontractors and related costs, such <br />as transportation, storage and rental costs for materials and equipment, <br />costs of utilities, fuels and sanitary facilities at the Project Site. <br />The allowance for overhead and profit shall be based on a reasonable <br />percentage of the Contractor's actual increased costs. <br /> <br />The Contractor shall keep and fUI'nish to the Engineer upon request an <br />accurate and complete documentation of all costs, including receipts, <br />invoices, cancelled checks and any other records or evidence necessary <br />to support his claim for an increase in the Contract Price. <br /> <br />Differing Site Conditions <br /> <br />The Contractor shall promptly, and before such conditions are disturbed, <br />notify the Owner in writing of: <br /> <br />Subsurface or latent physical conditions at the Site differing <br />materially from those indicated in the Contract Documents; or <br />Unknown physical conditions at the Project Site, of an unusual <br />nature, differing materially from those ordinarily encountered and <br />generally recognized as inhering in the Work of the character <br />provided for in the Contract Documents. The Owner shall promptly <br />investigate the conditions. If the Owner finds that such conditions <br />do materially differ and Ciluse an increase or decrease in the <br />Contractor's cost of, or the time required for, performance of any <br />part of the Work under the Contract Documents, whetller or not <br />changed as a resul t of such conditions, and equitable adjustment <br />shall be made and the Contract Documents modified in writing <br />accordingly. <br /> <br />No claim of the Contractor under this section shall be allowed unless the <br />Contractor has given the notice required above, except that the Owner may <br />extend the prescribed time. <br /> <br />(1 ) <br />(2) <br /> <br />No claim by the Contractor for an equitable adjustment hereunder shall be <br />allowed unless asserted before final Payment under the Contract Documents. <br /> <br />GC - 19 <br />
