<br />311.2 <br /> <br />If, within one (1) year after the date of Substantial Completion or such <br />longer period as may be required by law, any Work is found to be defec- <br />tive, the Contractor shall promptly correct such defective ,Iork at no <br />cost to the Owner. <br /> <br />312.1 <br /> <br />312. CONTRACTOR'S WARRANTIES <br /> <br />312.2 <br /> <br />312.3 <br /> <br />312.4 <br /> <br />The Contractor will indemnify and hold harmless the Goldsmith Metropolitan <br />District, Tech Center Development North, Ine., Ground ::ngineering <br />Consultants, Inc. and Greenhorne & 0'11ara, Inc. and their agents and <br />employees from and against all claims, damages, losses and expenses <br />including attorney's fees arising out of or resulting from the performance <br />of the Work, provided that any such claims, damage, loss or expense is <br />attributable to bodily injury, sickness, disease or death, or to injury <br />to or destruction of tangible property including the loss of use resulting <br />therefrom; and is caused in whole or in part by any negligen~ or willful <br />act or omission of the Contractor, and Subcontractor, anyone directly or <br />indirectly employed by any of them anyone for whose acts of them may be <br />1 i ab 1 e. <br /> <br />In any and all claims against the Owner or the Engineer, or any of their <br />agents or employees, by any employee of the contractor, any Subcontractor, <br />anyone directly or indirectly employed by any of them, or anyone for <br />whose acts any of them may be liable, the indemnification obligation <br />shall not be limited in any way by any limitation on the amount or type <br />of damages, compensation or benefits payable by or for the contractor or <br />any subcontractor under workmen's compensation acts, disability benefit <br />acts or other employee benefit acts. <br /> <br />The obligation of the Contractor under this paragraph shall not extend <br />to the liability of the Engineer, his agents or employees arising out of <br />the preparation or approval of maps, drawings, opinions, reports, <br />surveys, Change Orders, designs or specifications. <br /> <br />The Contractor shall guarantee all materials and equipment, except <br />landscaping, furnished and Work performed for a period of one (1) year <br />from the date of Substantial Completion. The Contractor warrants and <br />guarantees for a period of one (1) year form the date of Substantial <br />Completion of the system that the completed system is free from all <br />defects due to faulty materials at' workmanship and the Contractor shall <br />promptly make such corrections as may be necessary by reason of such <br />defects including the repairs of any damages to other pal'ts of the <br />system resulting from such defects. The contractor shall guarantee all <br />materials and equipment furnished and all work performed fOI~ landscap- <br />ing for a period of one complete growing season from the date of Substan- <br />tial Completion. The Contractor warrants and guarantees for a period of <br />one complete growing season from the date of Substantial Completion of <br />the work that the completed system is free from defects due to faulty <br />materials or workmanship and the Contractor shall promptly make such <br />corr~ctions as may be necessary by reason of such defects including the <br />repalrs of any damages to other parts of the system resulting from such <br /> <br />GC - 16 <br />
