<br />COLORADO FLOOD CONTROL <br />NIl DRAINAGE IAIS <br /> <br />DEFINITIONS <br /> <br />FORMATION <br /> <br />"The county planning commission or the board of <br />adjustment...may condition any portion of a zoninq <br />resolution, any amendment thereto, or MY. exception <br />to the terms thereof upon the preservation, <br />improvement, or construct ion of any storm or <br />floodwater runoff channel designated and approved by <br />the Colorado Water Conservation Board." (30-28-111) <br />(emphasis added) <br /> <br />The board of county commissioners may provide in <br />zoning regulations for the continued use or <br />termination of nonconforming uses, by specifying <br />periOdS for continuation or formula for amortization <br />to allow for recovery of investments (30-28-120). <br /> <br />The board of county commissioners may enforce zoning <br />plans after hearinq and adoption by designation of <br />districts. The district regulations must be uniform <br />and may require building permits for the erection of <br />structures (30-28-113). <br /> <br />The board of county commissioners after appointment <br />of a county or district planning commission, and <br />pending adoption of a zoning plan,may pass by <br />resolution and without hearing, temporary <br />regulations which may be effective for up to six (6) <br />months (30-28-121). <br /> <br />Note the definition of "SUbdivision" is important <br />for SUbdivision regulation. See related topic. <br /> <br />"Planning commission" means eithel: a planning <br />commission or, in a county where theJ:e is not a <br />planning commission, the board of county <br />commissioners becomes the planning commission. <br />(30-28-101(4)). <br /> <br />The board of county commissioners is authorized to <br />appoint a county planning commission, or in a county <br />with less that 15,000 population, the county <br />commissioners may act as the planning commission <br />(30-28-103). <br /> <br />Regional planning commissi.ons may be created by: <br /> <br />o the governing body or bodies of one or more <br />municipalities and the board or boards of county <br />commlSSloners of one or more counti.es in which <br />such municipalities are located, or <br /> <br />o the governing bodies of two <br />municipali ties acting independently <br />commissioners, or <br /> <br />or more <br />of county <br /> <br />II-B-4 <br />
