<br />COLORADO F LOOIl CONTROL <br />IINIl ORAINAGE LAWS <br /> <br />TOPIC TITLE <br /> <br />STATUTES <br /> <br />PURPOSES <br /> <br />RELATED TOPICS <br /> <br />SPECIAL POWERS <br /> <br />COUNTY GENERAL POWERS RELATED TO DRAINAGE AND FLOOD <br />CONTROL <br /> <br />Title 30. articles 11 and 20. primarily (30-11-101 <br />et seq.. 30-20-301 et seq.. 30-20-401 et seq.). <br /> <br />The purpose of this topic is to introduce general <br />county powers of particular direct relevance. Note. <br />however. that this description does not provide full <br />treatment of the general county financing laws and <br />other miscellaneous laws that may be relevant to any <br />particular case. In the case law concerning county <br />general powers. thE!re is a tremendous body of law <br />that may affect any particular case. Also. the <br />particularities of any home rule charter may affect <br />procedures and capacities. The extent of county debt <br />of general obligation may affect county capacities <br />to act. and also. county and local governments are <br />limited in their power to raise levies from one year <br />to the next by other statutes. Therefore. this <br />material is not a full treatment: a complete <br />consideration would defeat the purposes of this test. <br /> <br />The purpose of thE! statutes described here is to <br />allow counties to construct or acquire and finance a <br />variety of pUblic works which are in some cases <br />directly relevant to drainage and flood control. as <br />concerns of pUblic safety and welfare. <br /> <br />The formation of these districts is a principal <br />means for the accomplishment of many of the purposes <br />of drainage and flood control. See also County <br />Public Improvement Districts. County Local <br />Improvement Districts. County Planning and Zoning. <br />and County Sub-Division Regulations. <br /> <br />Counties are granted all powers necessary for doing <br />business. such as powers to sue and be sued. <br />maintain offices. purchase and sell property. make <br />contracts, and so forth (30-11-101). and also have <br />the power to: <br /> <br />o "expend moneys for the maintenance of drainage <br />structures and facilities and to accept dedicated <br />or deeded drainage easements or drainageways <br />tracts as county property once drainage <br />structures and facilities on such tracts have <br />been completed and found to meet county <br />specifications and standards." <br /> <br />I-B-.l <br />
