Halboth <br /> <br />Tony Peck of the Administration Division, Robert Steger of the <br />Planning Division, and Chuck Halboth and I of the Plant Division <br />met with you and John Blanchard of Wright Water Engineers on <br />June 28, 1991. At that meeting, your company's plan for diverting <br />a portion of storm water upstream of Rocky Flats around Rocky Flats <br />through the use of the South Boulder Canal was discussed. <br /> <br />H:\Kim\Wrlght.rls <br /> <br />Normally, the Denver Water Department (Denver) does not accept <br />storm water in its water supply facilities. However, according to <br />your letter to Mr. Hamlet J. "Chips" Barry dated March 29, 1991, <br />your plan will result in a net reduction in the amount of storm <br />water carried by the South Boulder Canal. For this reason, Denver <br />is willing to accept your plan. <br /> <br />Denver supports your plan provided the following conditions are <br />met: <br /> <br />1. There will be a net reduction in the amount of storm water <br />being carried by the South Boulder Canal. <br /> <br />2. The concerns I expressed in my letter to you dated April 22, <br />1991, are addressed to my satisfaction. <br /> <br />3. Denver accepts no responsibility for any possible injury in <br />quality or quantity to water rights affected by the proposed <br />re-routing of storm runoff originating in subbasin SL6 from <br />Upper Big Dry Creek to Coal Creek. EG&G shall indemnify <br />Denver for any damage caused by such plan. <br /> <br />4. The city of westminster agrees to waive its option to receive <br />water from the South Boulder Canal via the Woman Creek <br />drainage as stated in Paragraph 7 of the contract between the <br />City and County of Denver and the city of Westminster dated <br /> <br />CONSERVE.
