<br />I <br />I <br />I <br /> <br />Article 3 <br /> <br />Designation of Matters of State Interest <br /> <br />Governing Body to Make Designations. <br /> <br />1-301 <br /> <br />I <br />I <br />I <br />I <br /> <br />Designations and amendments or revocations of desig- <br />nations may be initiated in five ways: <br /> <br />(1) After a matter of state interest has been iden- <br />tified as provided in Article 2 of this Chapter, <br />the governing body may designate such matter in <br />accordance with the provisions of this section <br />and 831-23-301, C.R.S. 1973, recodified as 831-16- <br />101 by H.B. 1089 (1975). <br /> <br />I <br />I <br />I <br /> <br />(2) If the governing body finds that it would be <br />inappropriate to await identification of any <br />matter of state interest by the planning commis- <br />sion, the governing body may designate such matter <br />prior to adoption of the identification. <br /> <br />(3) If the Colorado Land Use Commission submits a <br />formal request to the governing body with regard <br />to a specific matter which the Colorado Land Use <br />Commission considers to be of state interest <br />within the jurisdiction, the governing body shall <br />Eublish notice and conduct a hearing pursuant to <br />!324-65.1-407 (1) (a), C.R.S. 1973. <br /> <br />I <br /> <br />(4) If the governing body receives a petition signed <br />by a number of qualified electors equal to at <br />least eight (8) percent of the total number of <br />votes cast for all candidates for governor in the <br />last general election in this jurisdiction request- <br />ing designation of any matter of state interest, <br />the governing bOdy shall begin designation proceed- <br />ings on that matter of state interest as set out <br />below. <br /> <br />I <br />I <br />I <br />I <br /> <br />(5) At any time after the designation of any matter of <br />state interest by the governing body pursuant to <br />court order, a proceeding to revoke or amend any <br />such designation may be held only upon the sub- <br />sequent order of the same court which ordered the <br />designation. <br /> <br />I <br />I <br />I <br />I <br /> <br />1-302 <br /> <br />Moratorium. <br /> <br />After the governing body has received a formal request <br />to take action with regard to a specific matter which the <br />Colorado Land Use Commission considers to be of state inter- <br />est within the local government's jurisdiction, no person <br /> <br />-8- <br />
