<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />Article 4 <br /> <br />Permits <br /> <br />l-40l Permits Required after Designation; <br />Receipt of Application Form. <br /> <br />(1) Any person desiring to engage in a development in <br />a designated area of state interest or to conduct <br />a designated activity of state interest must <br />obtain a permit from the permit authority. <br /> <br />(2) An application shall not be accepted unless it is <br />complete. If the application is considered incom- <br />plete by the permit authority, the permit authority <br />shall specify what additional information is re- <br />quired. When a submitted application is considered <br />to be complete by the permit authority or the appli- <br />cant, the permit authority shall note upon the <br />application the date and hour of its receipt. <br /> <br />(3) When the applicant seeks a permit to engage in <br />development in more than one area of state interest <br />and/or to conduct more than one activity of state <br />interest and/or to engage in development in one <br />area of state interest and to conduct one activity <br />of state interest, the application may be completed <br />for all such activities or developments and may be <br />reviewed by the permit authority in one consolidated <br />hearing. <br /> <br />1-402 Application Fee. <br /> <br />The application shall be accompanied by an application <br />fee in the amount(s) set forth in the regulation(s) for the <br />matter(s) of state interest involved in the application or <br />in such lesser amount as may be determined by the permit <br />authority. <br /> <br />1-403 Notice of Permit Hearing. <br /> <br />(1) Not later than thirty (30) days after receipt of a <br />completed application for a permit, the permit <br />authority shall set and publish notice of a date, <br />time, and place for a hearing on said application. <br />Such notice shall be published once in a newspaper <br />of general circulation in the jurisdiction, not <br />less than thirty (30) nor more than sixty (60) days <br />before the date set for hearing and shall also be <br />given to other persons and entities in the same <br />manner as set forth above for the notice of a <br />designation hearing in 1-304. <br /> <br />-14- <br />
