<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />II <br />I <br />I <br />I <br />I <br />I <br />I <br /> <br />SECTION THREE Affected EnVIronments and EnVIronmental Consequences <br /> <br />3.11 CULTURAL RESOURCES <br /> <br />In addition to review under NEP A, consideration of impact to cultural resources is required <br />under Section 106 of the National Historic Preservation Act (NHPA) as implemented by 36 CFR <br />Part 800. Requirements include the need to identify significant historic properties that may be <br />impacted by the proposed action or alternatives. Historic properties are defined as archaeological <br />sites, standing structures, or other historic resources listed in or determined eligible for listing in <br />the National Register of Historic Places (NRHP) (36 CFR 60.4). <br /> <br />3.11.1 Alternative 1 - No Action <br /> <br />No activities would occur under the No Action Alternative; therefore, this alternative does not <br />have the potential to adversely impact cultural resources. <br /> <br />3.11.2 Alternative 2 -Improve Routing of Pawnee Creek Flood Flows (Proposed <br />Action) <br /> <br />The Colorado State Historic Preservation Office (SHPO) was contacted to determine if there <br />were any known cultural resource sites within the project area. In a letter dated September 28, <br />1998 (Appendix C), the SHPO indicated there are no identified sites in the project area. The <br />SHPO also indicated their information is incomplete as the project area has not been surveyed for <br />cultural resources. Therefore, there is a possibility that unidentified cultural resources exist <br />within the project area. The SHPO requested that a professional survey be conducted of areas <br />that would be disturbed prior to the start of construction. If any cultural resources are found <br />which are eligible to be listed on the NRHP, consultation with the SHPO would be required. <br /> <br />In the event that cultural resources are encountered during construction, activities would stop and <br />the SHPO and the Region VIII Environmental Officer would be contacted. Construction would <br />not resume until appropriate coordination and required mitigation had been completed. <br /> <br />3.11.3 Alternative 3 . Pawnee Creek Overflow Cutoff <br /> <br />Potential impacts of Alternative 3 are the same as discussed in Alternative 2. All areas that <br />would be disturbed would require a professional survey prior to the start of construction. If any <br />cultural resources are found which are eligible to be listed on the NRHP, consultation with the <br />SHPO would be required. <br /> <br />In the event that cultural resources are encountered during construction, activities would stop and <br />the SHPO and the Region VIII Environmental Officer would be contacted. Construction would <br />not resume until appropriate coordination and required mitigation had been completed. <br /> <br />3.12 HAZARDOUS MATERIALS AND WASTES <br /> <br />The American Society for Testing and Materials (1994) Standard E 1527-94 defines a recognized <br />environmental condition as "the presence or likely presence of any hazardous substances or <br /> <br />3-19 <br />
