NO. 160 <br /> <br />i <br /> <br />COLORADO WATER CONSERVATION BOARD <br />823 state Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br /> <br />March 17, 1980 <br />RES 0 L U T L 0 N <br /> <br />WHEREAS,.a floodplain information report entitled "Flood <br />Hazard Area Delineation, Lee Gulch and Little Creek, City of <br />Littleton and Arapahbe County, Colorado," dated July, 1977, was <br />prepared by Ketchum, Konkel, Barrett, Nickel and Austin, Inc., at <br />the request of the Urban Drainage and FloOd control District, the <br />City of Littleton, and Arapahoe County; and <br /> <br />WHEREAS, the ColoradO water Conservation Board, as <br />requested by the Urban Drainage and FloOd Control District, by <br />Floodplain Resolution Number 86, adopted on November 15, 1977, <br />approved and designated the floodplains described in said report; <br />and <br /> <br />WHEREAS, the city of Littleton has submitted new data <br />and technical information to the colorado Water Conservation Board <br />that indicate that there is not sufficient depth of flow, rate of <br />discharge, and drainage basin area to justify the 100-year flood- <br />plain designation fOr certain parts of the South Fork of Lee Gulch; <br />and <br /> <br />WHEREAS, the city of Littleton has requested that the <br />Colorado Water Conservation Board rescind the 100-year floodplain <br />designation fOr certain parts of the south Fork of Lee Gulch; and <br /> <br />WHEREAS, section 37-60-106(1), ColOrado Revised statutes <br />1973, requires the ColoradO Water Conservation Board to assist in <br />the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-201 and 30-28-111, ColoradO <br />Revised Statutes 1973, provide that such legislative bodies of <br />local jurisdictions may provide zoning regulations for land uses <br />on Or along any storm or floodwater runoff channel or basin only <br />after designation and approval by the Colorado Water Conservation <br />Board; and <br /> <br />WHEREAS, Section 37~60-106(1) (c), Colorado Revised <br />Statutes 1973, directs the Colorado Water Conservation Board to <br />designate and approve storm or floodwater runoff channels Or basins <br />and to make such designations available to legislative bodies of <br />local jurisdictions; and <br /> <br />WHEREAS, the staff of the Board has reviewed said.new <br />data and technical information and does hereby recommend to the <br />ColoradO Water Conservation Board that the Board rescind the 100- <br />
