The infringement <br />onto CWCB property consists of a concrete plaza at the west entrance of the Riverfront <br />Mall building and drainage channel retaining walls along Little's Creek which were built <br />by the Writer Corporation in 1985. Another infringement within the urban renewal area <br />occurred in 1985 with the construction of a restaurant (now named Pitcher's), which has <br />been granted an easement by the CWCB. <br /> <br />Echostar is considering purchasing the Riverfront Mall building for use as its corporate <br />headquarters, marketing, legal, and customer support divisions. While the Pitcher's <br />Restaurant building has been generally occupied since 1985, the mall building has been <br />vacant since 1991, and is in danger of becoming a serious nuisance problem for the City, <br />and very unattractive neighbor to the Greenway Trail which runs along the South Platte. <br />The infringement was discovered as part of Echostar's due diligence process, and the City <br />staff immediately contacted Mr. Larry Lang, Flood Section Chief at the CWCB. <br /> <br />Representatives of Echostar and Littleton staff conducted a field review of the property <br />with Mr. Lang on August 14, and it appears that the improvements constructed in 1985 <br />by the Writer Corporation have had no impact on either the maintenance and operation of <br />the Greenway Trail by the South Suburban Park & Recreation District, or CWCB <br />maintenance responsibilities for the river channel. <br /> <br />EXHIBIT B <br />
