<br />TO: <br /> <br />Colorado Water Conservation Board Members <br /> <br />FROM: <br /> <br />Larry Lang <br /> <br />OATE: <br /> <br />September 15, 1997 <br /> <br />RE: <br /> <br />Addendum to Agenda Item 7.a.iii Memorandum dated September 15, <br />1997 - Staff Position Regarding the CWCB-COOT Right-of- Way <br />Negotiations. <br /> <br />Discussion: <br /> <br />At our September 16, 1997 meeting between CWCB and COOT with the Attorney <br />General's Office in attendance, the CWCB and COOT concerns were discussed in detail. <br />First, it was realized that COOT had changed their easement request location from the <br />Prince Street request to one which is located approximately five hundred feet (500') <br />upstream. The new request from COOT is for a slope easement and a drainage easement <br />rather than a roadway construction easement. COOT indicated that the Oepartment will <br />be addressing the Prince Street roadway easement request in the near future. In the <br />discussion, it was learned that the slope easement will not alter the topography or usage <br />of the CWCB lands. The easement area is needed as a highway safety requirement due to <br />locations of the new Santa Fe roadway. The drainage easement is for the location and <br />construction of a box culvert outfall drainage system which will be a sub-surface usage. <br /> <br />Recommendation: <br /> <br />The CWCB and COOT staff members have mutually agreed to the following <br />considerations for the CWCB lands. The CWCB staff proposes that these terms artd <br />conditions be considered by the Board for the requested easements as shown on the <br />attached map. <br /> <br />For the Slope Easement - COOT will secure a conditional easement which will require <br />the area to remain open space. There will be no compensation; however, COOT will <br />assist with future maintenance for the area. For the Orainage Easement - COOT will <br />secure a permanent easement for a 9,124 square foot area for a consideration of nine <br />thousand one hundred twenty four dollars ($9,124.00).
