<br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I <br />I I <br />I <br />I <br />I <br />I <br />I <br /> <br />IEmOITHREE AUected Environments and Environmental Consequences <br /> <br />Construction of the drop structure downstream from the Riverside Cemetery would approach, <br />but not encroach on the wetland area on the South Platte River. <br /> <br />Since construction activities would affect approximately 450 feet of stream, a General 404 <br />Permit would be required with this alternative. The USACE, in consultation with the Colorado <br />Department of Health, would also be responsible for 401 Certification prior to issuing the 404 <br />Permit. <br /> <br />3.10.2 Threatened and Endangered Species <br /> <br />Based on information obtained from the USFWS, the following federally endangered, <br />threatened, proposed and candidate species have the potential to occur in Logan County. In <br />accordance with Section 7 of the Endangered Species Act, potential impacts to each need to be <br />evaluated: <br /> <br />Endangered Species <br />Whooping crane <br />Eskimo curlew <br />Black-footed ferret <br /> <br />Crus americana <br />Numenius borealis <br />Mustela nigripes <br /> <br />Threatened Species <br />Bald eagle <br />Pallid sturgeon <br /> <br />Haliaectus leucocephalus <br />Scaphirhynchus albus <br /> <br />Proposed Threatened <br />Mountain plover <br /> <br />Charadrius montanus <br /> <br />Candidate Species <br />Black -tailed prairie dog <br /> <br />Cynomys ludovicianus <br /> <br />Based on available published information and information obtained during the site visit, the <br />project area was evaluated for habitat(s) utilized by these species. It was determined that habitat <br />utilized by six of the seven species does not occur in the project area or the project does not meet <br />the special conditions that threaten the species (e.g. sturgeon). Habitat used by the bald eagle <br />includes large cottonwood trees that are used as roost and perch sites. Large cottonwood trees <br />are present in the project area and some cottonwood trees would be removed; however, the <br />project area is less than 0.75 acres. Construction would occur between late spring and early fall <br />when eagles are not in the area; therefore, none of the alternatives would affect the bald eagle. <br />Based on these factors, it was concluded that the project does not have the potential to adversely <br />affect federally listed threatened and endangered species. This conclusion was confirmed by the <br />USFWS in letters dated March 18, 1999 and February 22, 2002 (Appendix C). <br /> <br />3-16 <br />
