<br />CONDITIONS OF USE <br /> <br />The following conditions regulate the use of computer programs developed <br />by the Corps of Engineers, Department of the Army: <br /> <br />The computer programs are furnished by the government and are <br />accepted and used by the recipient individual or group entity with the <br /> <br />express understanding that the United States government makes no <br />warranties, express or implied concerning the accuracy, completeness, <br />reliability, usability, or suitabIlity for any particular purpose of the <br />information or data contained in the programs, or furnished in connection <br />therewith, and the United States shall be under no liability whatsoever to <br />any such individual or group entity by reason of any use made thereof. <br /> <br />, <br /> <br />f" <br /> <br />.. <br /> <br />The programs belong to the Federal Government. Therefore, the <br />recipient agrees not to assert any proprietary rights thereto nor to <br />represent the programs to anyone as other than government programs. The <br />recipient also agrees that the programs and all documents related thereto, <br />including all copies and versions in possession thereof, will be <br />discontinued from use or destroyed upon request by the government. <br /> <br />The programs are to be used only in the public interest and/or the <br />advancement of science and will not be used by the recipient to gain <br />unfair advantage over any client or competitor. Whereas the recipient may <br />charge clients for the ordinary costs of applying these programs, the <br />recipient agrees not to le'TY a charge, royalty or proprietary usage fee <br />upon any client for the development or use of any program received, or for <br />any modification of such program by the recipient. Only minor or <br />temporary modifications will be made to the programs (e.g., necessary <br />corrections or changes in the format of input or output) without written <br />approval from the government. The programs will not be furnished by the <br />recipient to any third party under any circumstance. However, information <br />on the source of the programs will be furnished to anyone requesting such <br />information. <br /> <br />All documents and reports conveying information obtained as a result <br />of the use of the program(s) by the recipient will acknowledge the Corps <br />of Engineers, Department of the Army, as the origin of the program(s), and <br />for any assistance received in their application. <br /> <br />. <br /> <br />t.. <br /> <br />, <br />
