In evaluating <br />the acreage of wetlands to be debited, the evaluation team shall <br />first determine the normal water level for each wetland. This <br />determination will be made by using one or more of the fOllowing <br />data sources: <br /> <br />1. <br /> <br />Aerial photos from various years, <br />precipitation data of the area for <br />twelve months prior to the date of <br /> <br />and when available, <br />a period of at least <br />any photos used. <br /> <br />2. United states geological survey seven and one-half <br />minute topographic maps. <br /> <br />3. Where determined necessary by the evaluation team after <br />consultation with both the state engineer and the <br />commissioner, an actual onsite investigation. <br /> <br />4. United states fish and wildlife service's national <br />wetland inventory. <br /> <br />5. <br /> <br />United states department <br />conservation service wetland <br />implement swampbuster. <br /> <br />of agriculture soil <br />determinations made to <br /> <br />6. Any historical cropping records which are documented <br />and applicable to the situation. <br /> <br />7. Underlying soil type. <br /> <br />8. Any information considered important by the evaluation <br />team. <br /> <br />When any photos, documents or governmental determinations of <br />the presence or absence of a wetland is provided by the applicant <br />with the board approved permit, the evaluation team will consider <br />that information in making its determination. <br /> <br />The evaluation team shall coordinate its decision with the <br />state engineer's decision on a permit application of statewide or <br />interdistrict significance. <br /> <br />The sum of the area of land wi thin the normal water level <br />for each wetland to be drained will be the acreage of wetlands to <br />be drained. <br /> <br />History: <br />General Authority: NDCC 28-32-02, 61-32-04 <br />Law Implemented: NDCC 61-32-03, 61-32-04, 61-32-05 <br /> <br />-3- <br />
