Scope of chapter. This chapter contains rules <br />by which the state game and fish department and the state <br />engineer jointly determine the number of wetlands acres to be <br />drained and find those wetland acres will be replaced by an equal <br />acreage of replacement wetlands. This chapter includes rules <br />governing the wetlands bank. <br /> <br />History: <br />General Authority: NDCC 28-32-02, 61-32-04 <br />Law Implemented: NDCC 61-32-03, 61-32-04, 61-32-05 <br /> <br />89-02-03-02. Definitions. In this chapter, unless the <br />context otherwise requires, the following definitions apply: <br /> <br />1. "Applicant" means a person requesting a drainage <br />permit. <br /> <br />2. "Application" means an application for a permit to <br />drain made pursuant to section 61-32-03. <br /> <br />3. "Appropriate replacement acres" means fifty percent of <br />the wetland acres required wi thin the same county or <br />contiguous counties as the wetland being drained. <br />However, if less than fifty percent are available in <br />that county or a contiguous county, wetlands in the <br />same biotic area are considered appropriate replacement <br />wetlands. <br /> <br />-1- <br />
