A seven and one-half minute <br />topographic map indicating the location and size c.f the <br />wetlands approved for drainage shall be a+. a,ched to the <br />determination. <br /> <br />11. The board's notice to an applicant shall state chat the <br />board's approval of the application is not a permit to <br />drain until the state engineer has: <br /> <br />a. In the case of a drain determined to be of <br />statewide or interdistrict significance, also <br />approved the application and found the wetland <br />acres drained would be replaced by an equal number <br />of replacement acres; or <br /> <br />b. In the case of a drain determined not to be of <br />statewide or interdistrict significance, found the <br />wetland acres drained would be replaced by an <br />equal number of replacement acres. <br /> <br />History: <br />General Authority: NDCC 28-32-02, 61-03-13, 61-32-04 <br />Law Implemented: NDCC 61-32-03 <br /> <br />89-02-02-10. Board procedure for processing permits when a <br />hearing is not required. Upon referral from the state engineer <br />of a permit which is not of statewide or interdistrict <br />significance and will not drain permanent, semi-permanent, or <br />seasonal wetlands, the board shall follow this procedure: <br /> <br />1. The board shall review the permit application and any <br />supporting documentation and determine whether <br />protection of public and private interests would be <br />better served by a specific public meeting to consider <br />the project. If it is determined a specific public <br />meeting is necessary to protect public and private <br />interests, the board shall process the permit <br />application in accordance with the prov1sions of <br />section 89-02-02-09. <br /> <br />2. If the board determines a specific public meeting is <br />unnecessary, the board shall consider the project <br />pursuant to the cri teria set forth in section <br />89-02-02-14 and shall deny or grant the application <br />with or without modifications or conditions based upon <br />those criteria.
