<br />technical and floodplain management information to revise and update the floodplain delineations <br />contained on said floodplain map dated April I, 1977; and <br /> <br />WHEREAS, said new report includes, for references purposes only, the approximate <br />floodplain delineations dated April 1, 1977 prepared by FIA and approved by FEMA without the <br />revisions and corrections subsequently made by the Colorado Water Conservation Board; and <br /> <br />LOCAL REOUEST FOR DESIGNATION <br />WHEREAS, the City of Cortez, Colorado has requested technical assistance from the <br />Colorado Water Conservation Board to analyze and revise the flooding sources and 100-year <br />floodplain delineations within the corporate limits; and <br /> <br />WHEREAS, the City of Cortez, Colorado has requested the Colorado Water Conservation <br />Board to designate and approve the floodplain information contained in said new report dated <br />February 1999; and <br /> <br />C.R.S AUTHORITY <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, requires the Colorado <br />Water Conservation Board to assist in the prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS, Sections 31-23-301 and 30-1.8-111, Colorado Revised Statutes, provide that <br />legislative bodies of local jurisdictions may provide zoning regulations for land uses on or along any <br />storm or floodwater runoff channel or basin only after designation and approval by the Colorado <br />Water Conservation Board; and <br /> <br />WHEREAS, Section 37-60-106(1)(c), Colorado Revised Statutes, directs the Colorado <br />Water Conservation Board to designate and approve storm or floodwater runoff channels or basins <br />and to make such designations available to legislative bodies oflocal jurisdictions; and <br /> <br />COMPLIANCE WITH CWCB TECHNICAL sTANDARDS <br />WHEREAS, the 100-year peak flow values for the streams listed in Table I will be <br />estimated by the Colorado Water Conservation Board using acceptable hydrologic techniques <br />approved under the Board's "Rules and Regulations for the Designation and Approval of <br />Floodplains and of Storm or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, hydraulic determinations for the streams listed in Table I will be prepared by <br />the Colorado Water Conservation Board using approximate hydraulic techniques approved under <br />the Board's "Rules and Regulations for the Designtltion and Approval of Floodplains and of Storm <br />or Floodwater Runoff Channels in Colorado" (2 CCR 408-1); and <br /> <br />WHEREAS, the designation and approval of the approximate floodplain information is <br />contingent upon the understanding by the City of Cortez that appropriate hydrologic and hydraulic <br />analyses (as outlined in Tables 2 and 3) are performed by a registered professional engineer and <br />submitted by the developer prior to approval of all development proposals within those approximate <br />floodplains; and <br /> <br />2 <br />
