<br />I <br /> <br />, <br /> <br />., <br /> <br />;,.' <br /> <br />'\ <br /> <br />WHEREAS. the City of Westminster will. as owner of Ketner <br />Reservoir. maintain and operate said reservoir as a flood <br />control facility and assure its flood routing capability in <br />perpetuity; and <br /> <br />WHEREAS. the ci ty of Westminster has requested the Colorado <br />Water Conservation Board to designate and approve the floodplain <br />areas as set forth in the aforesaid new report; and <br /> <br />WHEREAS, Section 37-60-106(1) (c). Colorado Revised Statutes. <br />requires the Colorado Water Conservation Board to assist in the <br />prevention of floods and flood damages therefrom; and <br /> <br />WHEREAS. Sections 31-23-301 and 30-28-111. Colorado Revised <br />Statutes. provide that such legislative bodies of local <br />jurisdictions may provide zoning regulations for land uses on or <br />along any storm or floodwater runoff channel or basin only after <br />designation and approval by the Colorado Water Conservation <br />Board; and <br /> <br />WHEREAS. Section 37-60-106(l)(c), Colorado Revised Statutes. <br />directs the Colorado Water Conservation Board to designate and <br />approve storm or floodwater runoff channels or basins and to <br />make such designations available to legislative bodies of local <br />jurisdictions; and <br /> <br />WHEREAS. the <br />information and <br />requirements of <br />Designation and <br />Floodwater Runoff <br /> <br />staff of the Board has reviewed said revised <br />finds that it meets all of the applicable <br />the Board's "Rules and Regulations for the <br />Approval of Floodplains and of Storm or <br />Channels in Colorado"; and <br /> <br />WHEREAS. the staff does therefore recommend to the Colorado <br />Water Conservation Board that the Board designate and approve <br />the 100-year floodplain as described by the floodwater surface <br />eleva t ions and prof i les in sa id new report. and further <br />recommends that the floodplain designation for the portion of <br />Big Dry Creek from the crossing of the C. & S. Railroad upstream <br />approximately 6.000 feet, as approved by Resolution No. 270. <br />adopted January 23. 1987. and revised October 1. 1987. be <br />rescinded; <br /> <br />NOW. THEREFORE, BE IT RESOLVED by the Colorado Water <br />Conservation Board in regular meeting assembled in Denver, <br />Colorado. this 22nd day of March, 1988. that it does hereby <br />designate and approve the lOO-year floodplain described by the <br />floodwater surface elevations and profiles in said new report. <br />dated January. 1988. and does hereby rescind the corresponding <br />portion of Resolution No. 270, dated January 23, 1987, and <br />revised October 1, 1987; and <br /> <br />-2- <br />
