WHEREAS. the City of Westminster will. as owner of Ketner
Reservoir. maintain and operate said reservoir as a flood
control facility and assure its flood routing capability in
perpetuity; and

WHEREAS. the ci ty of Westminster has requested the Colorado
Water Conservation Board to designate and approve the floodplain
areas as set forth in the aforesaid new report; and

WHEREAS, Section 37-60-106(1) (c). Colorado Revised Statutes.
requires the Colorado Water Conservation Board to assist in the
prevention of floods and flood damages therefrom; and

WHEREAS. Sections 31-23-301 and 30-28-111. Colorado Revised
Statutes. provide that such legislative bodies of local
jurisdictions may provide zoning regulations for land uses on or
along any storm or floodwater runoff channel or basin only after
designation and approval by the Colorado Water Conservation
Board; and

WHEREAS. Section 37-60-106(l)(c), Colorado Revised Statutes.
directs the Colorado Water Conservation Board to designate and
approve storm or floodwater runoff channels or basins and to
make such designations available to legislative bodies of local
jurisdictions; and

WHEREAS. the

staff of the Board has reviewed said revised
finds that it meets all of the applicable
the Board's "Rules and Regulations for the
Approval of Floodplains and of Storm or
Channels in Colorado"; and

WHEREAS. the staff does therefore recommend to the Colorado
Water Conservation Board that the Board designate and approve
the 100-year floodplain as described by the floodwater surface
eleva t ions and prof i les in sa id new report. and further
recommends that the floodplain designation for the portion of
Big Dry Creek from the crossing of the C. & S. Railroad upstream
approximately 6.000 feet, as approved by Resolution No. 270.
adopted January 23. 1987. and revised October 1. 1987. be
rescinded;

NOW. THEREFORE, BE IT RESOLVED by the Colorado Water
Conservation Board in regular meeting assembled in Denver,
Colorado. this 22nd day of March, 1988. that it does hereby
designate and approve the lOO-year floodplain described by the
floodwater surface elevations and profiles in said new report.
dated January. 1988. and does hereby rescind the corresponding
portion of Resolution No. 270, dated January 23, 1987, and
revised October 1, 1987; and
