<br />Accompanying this letter is the legal oplnlon, dated May 8,
<br />1978 rendered by Mr. Edward J. Krisor, Jr., of Shoemaker & Wham.
<br />This legal opinion and any clarifying responses will have to be
<br />included in the Phase B report. I ask you to review it and
<br />approach any subsequent Phase B master planning work in light of
<br />the legal constraints discussed.
<br />
<br />By copy of this letter, I am aSking Arvada, Westminster, and
<br />Jefferson County to review this legal opinion and to make it a
<br />part of their consideration in selecting an alternative for pre-
<br />liminary design during Phase B. I direct your attention to Reach A lB.
<br />The legal opinion discussed the relocation of the watercourse to the
<br />east side of the railroad tracks. Should this relocated watercourse
<br />fail to act as designed, which oftentimes happens when unforeseen
<br />channel and culvert clogging occurs during floods, the parties in-
<br />volved in implementing this alternative may be faced with liability.
<br />In light of this, I question the District's participation in the
<br />implementation of this alternative.
<br />

<br />W. Joseph Shoemaker has received your letter of April 12,
<br />1978, including the above-referenced report, and has requested
<br />that I render a legal opinion as to the recommendations contained
<br />in the report. I have read the report in its ~ntirety and have
<br />viewed the areas in question with you as my gu~de. As I see the
<br />report, it is meant to be an engineering and ~lanning.app:oach to
<br />the drainageways of Little Dry Creek located In the ~~str~ct, and
<br />my comments contained in this letter are ~eant to ra~se an~ cove:
<br />potential legal issues and should not be ~nterpreted as belng cr~-
<br />tical of the report, nor as substituting my judgment for yours or
<br />Merrick and Company.

<br />Generally, in my opinion, the City of Arvada: Ci~y of West-
<br />minster, Jefferson County, Adams County, and the D~str~ct, who are
<br />paying for this report, have no oblig~tion to do anything about
<br />the dangerous conditions which now ex~st, ex~ept perha~s to call
<br />to the attention of the owners and dwellers ~n the Bas~n such con-
<br />ditions. Private parties, for the most ~a:t, have ~reated the
<br />hazardous and potentially hazardous cond~tlons and ~n the event.
<br />of loss of life or property such persons damaged would have the~r
<br />recourse against the tort feasors.
<br />
<br />Although government has no obligation to help solve these
<br />man-made problems, if, for various reaso~s it c~ooses to do so,
<br />which is the prerogative of the legislat~ve b?dles of.each g?vern-
<br />ment, then it must make certain that such asslstance lS c~rr~ed out
<br />in a non-negligent manner. I do not believe the law requlres local
<br />governments to prevent or even solve drainage and floo~ co~trol
<br />problems. However, if a government chooses to do so, ~t wlll be
<br />held to the same standard of care as a private party.
