Your having paid the correct amount of <br />premium: and <br />2. Our reliance on the accuracy of the in. <br />formation and statements you have fur- <br />nished; and <br />3. All the terms of this policy. the National <br />Flood Insurance Act of 1968. as amended. and <br />Title 44 of the Code of Fede",l Regulations. <br />On this basis. you are insured up to the <br />lesser of: <br />1. The actual cash value. except as provided <br />in Article 8. not including any antique value. <br />of the property at the time of loss: or <br />2. ',han the inter- <br />est of the named Insured. <br /> <br />Article 2-Definitions <br /> <br />As used in this policy- <br />Act means the National F"ood Insurance <br />Act of 1968, and any acts amendatory there- <br />of. <br />Actual Cash Value means tlle replacement <br />cost or an insured item of ~roperty at the <br />time of loss. less the value or physical depre- <br />ciation as to the item damaged. <br />Application means the statement made and <br />signed by you or your agent. and giving in- <br />fonnation on the basis of which we deter- <br />mine the acceptability of the risk. the policy <br />to be issued and the correct. premium pay- <br />ment. The correct premium payment must <br />accompany the application for the policy to <br />be issued. The application is. a part of this <br />flood insurance policy. <br />Association means the grou:p of unit owners <br />which manages the condomi1tium building in <br />which you. as the insured uILit owner, main~ <br />tain your residence. <br />Base flood means the flood haVing a one <br />percent chance of being equalled or exceeded <br />in any given year. <br />Basement means any area of the building. <br />including any sunken room or sunken por- <br />tion of a room. having i~. noor sUbgrade <br />(below ground level) on all sides. <br />Building means a walled c:nd roofed struc- <br />t\1...... other tha.n a gas or liquid storage tank. <br />that is principally above ground and affixed <br />to a permanent site. including a manufac- <br />tured (i.e.. mobile) home on a permanent foun- <br />dation, subject to Article 6. paragraph H. and <br />a walled a1ld Toofed building in the course of <br />constrUction. a.lteration or repair. <br />Cancellation means that poDding of the in- <br />surance coverage pro, "idee by this policy <br />prior to the ezpiTation date. <br />Coastal High HazaTd Area means an area <br />subject to high velocity waters. including <br />hurricane wa.ve wash and tsunamis. <br />Condominium means a system of individual <br />ownership of units in a multi-unit building or <br />buildings or in single-uni1; buildings as to <br />which each unit owner in the condominium <br />bas an undiVided interest in the common <br />areas of the building(s) and facilities that <br />serve the building(s). <br />Condominium Association Policy means a <br />policy of flood insurance coverage issued to <br />an association pursuant to the Act. <br /> <br />I <br /> <br />257 <br />
